You cant return underwear under the Distance Selling Regulations.

Yeah you can although it's not very polite to wear it first.

I quoted from Which? Consumer Rights - Which(!) considering their reputation you would expect them to have the right information.

    Your original post was

Which isnt helpful in the slightest. However had you posted:

So you say you posted it as you went to find out the correct legislation, im sure your post could have held on for a couple of minutes.

    Anyway, not here to argue.

Yet you do continue to argue, on this and other threads?...I drew attention to your error and yet it was my post that was not helpful? Can I suggest I was helpful in pointing out your post wasn't true? Was your post wrong and therefore unhelpful?

I'm sure your post could have waited until you correctly verified the legislation...you didn't though. You chose to quote a Commercial organisation....do think on that. I prefer the real deal.

Who rattled your cage! I havent posted in the thread for two days. What makes me chuckle is my last post finished "Anyway, not here to argue." so maybe you could enlighten me as to how am I arguing?

Im accepting that the information I posted from Which? was incorrect. Theres not much more I can do about that! I just said you would expect the information posted by Which? to be correct considering they are all about consumer rights.

Your original reply? - "Not true!!!" - Yeah very helpful! At this point I was still under the impression the Which? publication was correct. I really dont understand why you cant see that simply posting "Not true!!!" isnt very helpful!

Again, you really seem to have a bee in your bonnet? Why would I then want to trawl through legislation when I have the information which I believed at the time to be correct from a credible source?

I'd say this refers to things that are perishable, have a short life, medications etc

So what's the difference between me slipping into a M&S pair in a changing room in a bricks and mortar store and deciding not to buy because they are a poor fit and doing the same at home?

Its not just underwear! My friend bought jeans from asda and well...they were crusty at the crotch (on the inside). They said it looked liked dried menstrual bleeding!

Paralells the poo smearers I think.

I have emailed them as per your instructions.

    Hopefully this does the trick!

    A.

I was just wondering how you got on, as I am in the same situation - I ordered a few bits from them & returned them, but have now been advised that they have placed a credit note on my account, rather than refunding. I had no idea that they didn't refund sale items, as you have to specifically read their returns policy to find that out - there is nothing advising you of it on the product page.

I can't see that it should make any difference that it's underwear, as they would've refunded the same item when returned before it was reduced?

The law has changed since this thread was started. Retailers can now refuse to refund items if a hygiene seal has been broken. If they do offer a refund it must be in the same form as the original payment though, unless they get your consent to give it in another form. That means that store credit is not allowed unless you paid with a credit note originally.
