Refused by ombudsmen - what next?

I have been turned down by FO on my PPI claim for Yorkshire Building Society. I have appealed and this is their final decision.


Is the only available action left to me court action or do I have another course of action? Thank you in advance.

    Why has your complaint been rejected at all three levels? (Bank, adjudicator, Ombudsman)

    Is that not telling you that your complaint may well be unjustified?

    When did you take out the loan?

    IT was take out in 1998 and ended 2002, they are saying that that I cart prove what was said at the time of sale, I was told I had to take out the MPI to get the mortgage but they but they are saying I could of cancelled it.they also are saying I would of benefitted from having the MPI.

    #1 As per comments below it may well be time barred under statute of limitations.

    #2 If you did take it to court, what law has been breached and what evidence has you got? As you're going to need to demonstrate one - it's not a kangaroo court like the FOS.

    #3 At that time it may well have been a condition of the offer that you take out PPI to cover you against sickness or unemployment. There's nothing wrong with that if it genuinely was.

    If the decision has been made by an Ombudsman then that is it as far as the regulated complaints process is concerned.

    The FOS are more consumer friendly than court. However, when you make an allegation, you have to support it with evidence. The FOS may consider your verbal allegations and look at your wider situation but if nothing points to what you are saying being true then they have to disregard them. A court will ask you to provide evidence to support your allegations. So, what evidence do you have?
    I was told I had to take out the MPI to get the mortgage but they but they are saying I could of cancelled it.

    MPPI has a much lower success rate with complaints than other types of PPI. It has less failure reasons (e.g. monthly premium standalone is how PPi should be. It covers a major debt with lifestyle changing consequence if it goes unpaid (unlike loan/credit card) and it tends to be of a better coverage than loan and credit card versions.

    I do believe Yorkshire b/s did insist on some insurances in the 90s. If they did, then that is allowed.

    You have just about the weakest complaint going. No evidence to support it against a PPI product which has the lowest success rate on complaints. You were always likely to fail on this one and you can be barred from legal action which is probably lucky given how flimsy your case is.

    You don't have that option. Your case has not been upheld and your complaint is over. Court action was never a realistic option, even less so now.

    ok thanks people, its the first time I have been turned down I have got ppi back from other mortgages and loans going back to the 80s, so not done to bad over the last 5 years, I will have to let this one go. Thank you all for your replies.

    It sounds like your PPI was not mis-sold so you're right to move on.
