Mail Order Co. refusing to accept return of faulty X-Box

My son's partner purchased X-Box as a gift for my grandson from mail order company in October but it was found to be faulty when powered up on Xmas Day.
Mail Order company says that because item was not reported/returned within their terms (28 days), the X-Box must be sent for repair and gave a location in Czech Republic at a cost of £40 to be borne by her.
Can they do this? I thought that sale of goods act stipulated that any item found to be faulty thru reasonable use within the first 6 months was the responsibility of the shop/distance seller to put right and that her responsibility is just to get it back to the shop or the 'local' address of the distance seller?

Learn from the mistakes of others - you won't live long enough to make them all yourself.

Was it a proper UK company, or the cheapest it could be found for online?
This is where paying a little extra for good customer service comes into it's own, and why I still shop on the high street from time to time.

Have you contacted Microsoft to see if the console is covered under their warranty?
If it is, I'm sure that there will be a repair station in the UK, and whilst you will still have to pay for the shipping, it won't cost anything like £40.0 -
It is faulty - the retailer bears the returns costs surely?0
-
If the sale was under UK jurisdiction and the fault is inherent then the retailer certainly has to cover all costs.0

Yes, but if the retailer is not in the UK then it is extremely difficult to get this enforced.
I'm not saying that this is the case, but as they want the faulty unit shipped to the Czech Republic, this might be where they are based.
If Microsoft will carry out the repair themselves, it might be worth spending a few £s for what will probably be a far better service.0 -
Go direct to Microsoft. You'll have your xbox back within 7 days with a complimentary one month xbox live free!

Their repair center is in the Czech Republic, but Microsoft arrange and pay for the collection via UPS if I remember correctly.0 -
Please help! I bought a tablet for my father for Xmas from ideal world. Ordered on Nov 3. He opened it on Xmas day and plugged it in to charge. Connection is very loose in tablet and therefore the tablet won't charge properly,it only reaches around 9%. I contacted ideal world who said that as it was not returned in the 1st 14 days they will not refund my money but I can send it back to them to be repaired. Are they legally allowed to refuse me a refund?0
