Evicting a tenant ..section 21 and section 8 notices

    It's not a black and white issue.
    It is less likely that they will receive help with being re-housed though.

    The husband has left/been kicked out of the home by his wife, maybe due to some drink/drug abuse, I'm not 100% sure, they have 3 kids aged 7, 15 and 17.

    Would that have a bearing on the issue?

    Can she not get housing benefit and stay? Similar happened to us, although they never missed any rent payments. Husband left the wife and kids. When the existing tenancy ran out in joint names we issued a new one in just her name (although I'm not sure we if ended the joint tenancy correctly?!). She is still there a couple of years on and receiving housing benefit, never missed a rent payment. Best tenant we've ever had to be honest.

    I was thinking along the same lines.

    I would be more than happy for her to stay, if the rent was covered, but I'm not sure how much housing benefit is per week/month for a 3 bedroom house here.

    Having said that....I'm not sure I would be happy to have the husband back as a tenant if there were some kind of 'reconciliation!

    BUT....I would have more chance of recovering my debt if I knew where he was!

  • You can find out the maximum the Local Authority will contribute via LHA by looking on their website IF they qualify for a three-bedroomed property in the first place.

    For the most part, regardless of the ages of the children, they are unlikely to be offered a council property if they are evicted for non-payment of rent, such is the scarcity of available housing-stock.
