Argos delivered faulty white goods

Hi all,

Argos delivered a tumble drier on the 31st of Dec. There is a fault on the drum and they were made aware immediately.

Today (3rd Jan) they sent an engineer out who didn't even have to look properly to see that they had not fitted the drum properly when it was assembled.

The engineer is writing up his report but in the meantime I've called customer service who say I'm not entitled to a refund or a replacement, but instead they will repair it.

Surely this can't be right? The item was clearly faulty and not fit for purpose when it arrived.

    No, it's not right.
    Contact them again and tell them that you are rejecting the drier as per your right under section 35-2 of the Sale of goods act.
    This states that you must be given a reasonable opportunity to examine goods before you are deemed to have accepted them, and if they are faulty or not as described then you have the right to reject them for a full refund.

    When am I entitled to a refund?
    If you have not in the legal sense
    'accepted' the goods, you are entitled to reject them and claim a refund of the
    money you have paid or a credit back to your credit or debit card. Rejection
    means informing the trader that the goods are faulty and that you do not want
    them.

    A relative of mine had a fault on a Washing Machine with Argos. The engineer who came didn't do anything and said nothing was wrong with it. In the end I wrote a complaints to Argos Customer Services (Sent recorded) stating about the 12 month warranty etc. The washer was just under six months old.


    Result in 14 days a brand new washing machine was delivered which was £100 more plus an Argos Gift Card of £50 as a good will gesture! :T
