Excel Parking - PCN

Bit of a tricky one here "/
I've read through a fair few posts and can't find an answer I'm looking for so..

I parked on a Private Car Park operated by Excel. My stay was only for 21 minutes and not once did I leave the car due to the fact that I'd forgotten my purse. I pulled onto the car park, parked in a bay, realised my error and phoned my office at work to make sure my purse/handbag was in my office. Thus this taking approx 10 mins to clarify from one of my company's colleagues.

Anywho, my point is that, I couldn't pay had I no purse, I was there only 21 minutes (I'm not sure if the car park offer any 'free' time at all) but regardless, and once the office had confirmed I had actually left my purse there, I drove off of the car park and returned to work. As I said, not once did I leave my vehicle.
Also, the two photo's I received are very dark.. You couldn't for the life of you see if there was a valid ticket or not in the window with these conditions, the front of my vehicle is barely visible.

Please could someone help me and define my actions I could take to appeal this, much appreciated.

    Even if you think your situation is a 'bit different' to anything else you've read, the reality is, fundamentally it is not.

    You've received an unenforceable parking invoice, that, regardless of circumstances, you can appeal and get quashed. I'm afraid, as much as you think it important, your story is of no relevance to this, and the sooner you 'forget' it, the sooner you will start to understand all this and be able to focus your mind on how to get rid of it.

    The more you understand, the better you will deal with it successfully.

  • Per Umkomaas, NO CHARGE issued by a parking company carries ANY substance WHATSOEVER. I can't emphasise this enough.

    So long as you realise that you are to expect a rejection of your representation from Excel who frankly couldn't care less about your personal circumstances nor your good will actions in their client's interest. That is a business which is primed to make big illicit profits out of intimidating vulnerable individuals and misleading them with their false accounts of your rights and the whole situation in general.

    There are easy ways to defeat them at the next stage however which is POPLA, so follow those guidelines and if you have any questions, please come back to this thread and ask away!

  • Thank you Guys, I think I have enough just to submit an appeal, not based on my 'story'
    I shall enforce that I WANT a popla code if unsuccessful, obviously it will be unsuccessful until popla take action.

    Can I also email them as it says 'To appeal or challenge this notice please do so in writing within 28 calendar days of the issue date of this notice'
  • I've shredded alot from #7 and have sent my letter. Thank you so much for your help.

    Obviously they will throw back the POPLA Code to me, which then I will need to appeal to them, what are my best actions in regards to this as they are more.. "Businesslike"

    You can only email an appeal if the letter says they accept emailed appeals. Hope you followed what it says and submitted it in good time.

    You will win at POPLA when you follow the links in 'How to win at POPLA' in the Newbies sticky thread already mentioned. Easy to beat Excel, so far in 2013 they've never been seen to send POPLA an unredacted landowner contract and cannot show the charge is a genuine pre-estimate of loss (as long as you include those points in your POPLA appeal of course, as per the usual examples).

    Also in P&D car parks we 'think' Excel actually already get paid by the landowner in some cases, allegedly. Hard for them to show any 'loss' then! You can find recent discussion of this and other Excel POPLA appeal wording, if you just search this forum for the keyword 'Excel'. If it was the Peel Centre you will find even more results by searching this forum for the keyword 'Peel' as we get posts every other day about that place.
