car phone warehouse messes up

Hi all, just some help please. I got my son a contracted phone through Three in my name 2 years ago. Now he's 18 and working, when his contract was up he went to car phone warehouse to start a new contract on an ee phone. They did ask about his old phone and contract and said they could upgrade it.
He wanted to get it all in his own name etc so it could be all his own.
Yesterday I received a letter yesterday informing me of my new contract and when they will be taking the money out of my account etc. The actual paperwork my son signed in the shop is in his name.
Not sure what I'm getting at here but how can they access my details without me being there? And how can a contract be taken out in my name without my knowledge and me signing anything? Is there a breach of data protection or even fraud committed here?
Sorry for so many questions but I'm going down there tomorrow and just need to know where I stand?

    Only you can cancel or upgrade your contract. I guess your son hasn't made clear enough that he wasn't the account holder.

    Just call the network first and ask if the contract can be transferred to your son's name (subject to passing a credit check). Your son has to present during the call as well.

    Sorry I didn't make myself clear. He went in asking for a new contract for himself but they said they could upgrade his phone to which he replied no I want my own contract. They must have accessed my details from the number and now it's in my name ??

    OK, you can either go to CPW, complain and demand cancellation or try calling the network as suggested above.
    In fact CPW don't need many 'details' for upgrading.

    If he wanted to keep his number and stay with 3 wouldn't it have to be an upgrade? Perhaps that was the reason?

    This is correct, however on most (if not, all) networks, only the account holder is allowed to extend the contract (some exceptions are business contracts).

    If CPW had done their job properly, they would not have processed this without you being present.

    Even if your son was being dodgy (and I'm not saying he was), CPW should have carried out the necessary account checks first.
