Parking Charge Notice Peel Centre - Stockport Help?

I am hoping somebody may be able to help me? I have received a notice as I am sure many of you are aware of these types of PCNs from Excel? I am being 'fined' for an alleged contravention of a parking contract in December in the evening. I was visiting the toy store had no idea that I needed to pay or else I would have done. I have read a lot of the information on the forums and obviously they are all particular but I have noticed there is a theme. I need to pay if I want the lower charge asap but I am unsure if I have a case if I genuinely did not see the signs or if I need to be entering into more of a legal argument regarding their rights to charge me? Any initial advice would be greatly appreciated.

    dozens of threads on this and easily won at popla

    start with the NEWBIES - READ THIS FIRST sticky thread, check the time order of what will happen and get up to speed, check the links for templates etc, especially for the peel centre , and get a soft appeal in to excel, then a popla appeal when they reject your soft appeal

    this forum will help you all the way if you get stuck, but there are dozens of examples on here about the Peel centre, in future park in Tesco and walk , lol

    You DO NOT NEED TO PAY!!! Everyone has a case and we win every time at appeal (POPLA). You will too if you follow our advice re the appeal wording. It's simple.

    The 'Private Parking Ticket? Newbies please read this first!' thread is on page one and answers all the usual FAQs and gives you links to examples you can adapt for your first challenge. You do not comment about whether 'the driver' paid & displayed but you can mention 'the driver did not see the signs as they had a genuine belief it was a free shoppers' car park'. That won't win your case in the end though, we know you will win on other grounds in a decent POPLA appeal written as registered keeper (NOT WRITTEN AS IF FROM THE DRIVER).     Sticky threads 'stuck' at the top and the 'Newbies' sticky thread also has a simple link 'How to win at POPLA' with examples for that stage too. It is EASY to beat Excel.

  • Thanks for the replies, I haven`t been able to address this yet. I am writing my appeal tonight. Does it need to be worded fancy or do you think it is ok just to simply state the basics of inadequate signage to get the popla code?
  • Is this sort of thing ok? or does it need to be more detailed? the impression i have it that this is simply to get a code?
    I am writing as the registered keeper of the above vehicle. The driver visited the Peel Centre Car park to visit one of the retail stores (please see attached receipt for proof). The driver believed the car park to be free and did not see any signs to the contrary. The charges which you are seeking are not a true representation of any alleged losses which you have made as a consequence.
    Please cancel the charge immediately. If you do not cancel the charge Please send me a POPLA code so I can submit an appeal through the relevant independent appeals service.

    trouble is that it admits that the driver did not pay, and its a P&D car park !!

    Dear Excel,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to you company is denied on the following:

    1) this charge is not a genuine pre-estimate of loss
    2) your signage does not comply with the BPA Code of Practice
    3) you do not have the authority or permission to issue invoices at this location

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter or supply a popla code to appeal to them.

  • Thanks, that is far better. I was under the impression it was just to raise a POPLA code and therefore was reluctant to raise the above points at this stage, but I suppose it makes more sense this way.
  • Just an update, They have refused the appeal as they are saying it is evident from the correspondence that I was not the driver of the vehicle on that day (not sure how they work that out). They have given me the option of appealing to POPLA, so I have requested that option obviously!
    May need some guidance on where to go next.
    I will read as much information as I can in the meanwhile.

    use one of the recent POPLA appeals for the Peel centre as it features on here every week, so ready made appeals that you can plagiarise ;)

    dont name the driver, they always use that phishing exercise ploy , ignore it and get the popla code and use it

    Did they not include the POPLA code nor POPLA form now with this rejection letter? You should NOT have to ask.
