  • Probably yes. Roadchef is a motorway service area, it ranks third in size after Welcome Break and MOTO.

    Yes, there will be no "No Return Within" period! The reason is that they believe you cannot drive off and back on as it is a motorway but there is such thing as a staff entry/exit. Misuse of that would be a case of trespass but that is not the task of the parking company to manage, that is the landowner - and subsequently there can be no financial charge for trespass nor can it form part of any contract.

    On top of all else in your favour, you now have one more weapon in your fight with CP Plus.
  • Roadchef nowadays has a 24-hour McDonalds in place of the one time hotplate which served breakfast all night long. All falling into place now.

    Strensham is one (M5) and the services near Southampton (M27) is another.

    Thank you for the link. Having had another read of BPA codes of practice has allowed me to formulate an angle. Based on this I am going with the following arguments:
    - Lack of contrast/illumination as late at night + poorly placed signs (away from parking lighting/headlights and at dangerous turning points)
    - Poor weather conditions
    - Unrealistic estimate of loss
    - Extortionate costings

    Does that sound plausible?

    It makes no difference what you put in your initial appeal as you will be looking to win at popla as ppcs reject most appeals anyway. So just put what you like and get it sent off

    So this was a Motorway Services Area (MSA for short on this forum).

    Once you have sent off your first appeal, spend a few minutes searching the forum for the single keyword 'MSA' using the 'search this forum' heading above the sticky threads, next to 'forum tools' on page one of this parking ticket board. The search facility on MSE works well and there are loads of MSA threads including some which show their winning POPLA appeal wording. There are specific requirements for MSA traffic signs, you will learn.

    So, signage is a specific issue to raise for POPLA in MSA cases, as well as the usual winning POPLA points you will find explained in 'How to win at POPLA' which is a link in the ''Newbies'' sticky thread.

  • And also where ANPR is concerned, NOT every inch of an MSA is subject to the terms and conditions of the signage. The camera merely captures you entering and departing and has no further information concerning your movements in the intervening time, nor whether you were even parked. There are sections for which there is no signage and your presence there would amount to trespass, the landowner's problem and nothing for which he can sue, and nothing for which he can press charges in retrospect when there is no evidence of damage.

    Big Bad Dad thank you for the extra info. I just wanted to get clarification on the points you raised around the services access routes. Am I able to check if this is relevant to the J8 M20 service at Maidstone? I only ask as i have been looking at Google maps and from their overview there appears to be no additional routes beyond the ones i know are key roads through the complex. Furthermore it seems the complex backs onto the railway. Any thoughts?

    However you want. If there's an appeals' portal on their website use that, you should then get an automated confirmation of receipt.

    If it's just an email address you might want to send it that way, with 'insurance' of a paper version sent snail mail (with free proof of posting from your PO).

    Even using an appeals' portal, you might want to send your 'insurance' copy too.

    No point in sending 'Signed For' - unnecessary expense, with the danger they won't accept it as they probably know what it is and it has an audit trail attached to it.

    The less evidence they provide, the more secure they feel within their scam.
