Parking in disabled space - hypothetical question

Was at a job today which involved carrying a lot of heavy stuff (ladders, etc) round the back of a house. The street was full of parked cars and the closest parking space was a few hundred metres away.

I spotted the next door neighbour leaving and asked if he minded if I parked the van in his disabled space for a an hour and a half. He said he had no problem with this, however a traffic warden probably would. According to him the space doesn't belong to him, but rather is for blue badge holders in general and without a blue badge I would get a ticket.

The space was marked on the road as a disabled bay, but the sign beside it said "reserved for disabled occupant" rather than the more general "blue badge holders only".

Based on this sign and the fact that the disabled occupant had given me his permission, I took my chances and parked there anyway reckoning I had a good defence.

I didn't get a ticket, probably due to all the traffic wardens enjoying the scottish bank holiday, but in theory could a traffic warden have legitimitely issued me with a ticket?

    Yes, because he would not have known you had permission. You would have then had to lodge an appeal.

    Can we have parking bays with signs saying that they are for abled bodied people only?

    Yes you could get a ticket, as someone who had a disabled bay outside his last property the bay is registered to a certain car/certain cars, if traffic warden looks at the number plate they will know that car is not supposed to be parked there.

  • Thanks for the responses. So, if I had been issued a ticket, could I have legitimately appealed it?

    Again, hypothetical question as the company I work for gets a huge amount of parking tickets and I think they just tend to pay them without appealing.

    But if it had been my personal vehicle for example, could I have appealed?

    Different situation, but slightly similar... We parked on the yellow line across our driveway, which was obviously there for our benefit. We received a ticket, and successfully appealed it.

    If it is true of that space that it's registered to a certain household, then I would have said many councils would accept the appeal, if you could prove that you were given permission to park there.

    If it's for general use of blue badge holders, though, I imagine they wouldn't accept the appeal, since the householder didn't have the right to give you permission in the first place.

    Presumably, the council would expect you to stop in an area where you could unload the heavy items, and park somewhere designed for able bodied people to use.

    Ahh...more people that can't understand why someone who has motability issues might need a parking space close to their home / shops ect.

    Churlish you might claim but the Pc world we live in says no discrimination. That goes for anyone. Hence why disabled toliets are now easy access etc etc.
