    Thanks Redx for pointing out your post. I had scrolled past it, and hadn't read it..

    I have now extended the letter after point 3, by including:

    ==========================================
    4. There was a valid disabled badge displayed on the vehicle at the time, and as per Equality Act 2010 this unfair pursuit breaches BPA Code of Practice

    5. Your signage does not comply with the BPA Code of Practice

    [from Stroma's template letter, thanks!]
    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of of your alleged loss, and your full unredacted contract with the landowner.
    [from Stroma's template letter, thanks!]
    ===========================================

    Anything else I am missing?

    Also, after having read your post regarding recorded delivery, I will send it via normal post, and will get proof of posting.

    Just in case if I did appeal online, what happens if Parking Eye denies getting any appeal?

    no reason why you cannot do both, a letter with proof of posting and an online appeal

    these people do not play fair and they can and do say that appeals are missed or beyond deadlines
  • Fair enough. I will do both.

    Thanks, and will let you know how things progress.

    Yep but no need for recorded delivery - get free proof of posting by asking at the PO counter.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • So Parking Eye have now written back to me. They have sent a letter a few pages long saying that the GPEOL is no longer a valid claim and included a list of POLA cases where GPEOL wasn't accepted as valid claim.

    AND, they still haven't given the POPLA Code. It also seems they have ignored all other points that I mentioned in my previous appeal letter.

    So, is this something they normally do, or have started doing against appeals?

    Time for complaints to BPA and DVLA (if you haven't already). See the NEWBIES thread.

    Failing to give a POPLA code when rejecting an appeal is a clear breach of the BPA Code of Practice.
  • Thanks bod1467. I will write a complaint letter to BPA and DVLA as suggested.

    Where should I leave things with ParkingEye?

    I was thinking of writing back to them and letting them know that I have complained against not receiving a POPLA code and that they haven't replied on any of the other appeal points.

    Write this

    Dear Parking Eye

    In reference to the letter received xxxxx. I see that you've tried to circumvent my legal right to use popla on the rejection you've supplied with the junk about genuine pre estimate of loss not being accepted at popla. It's funny that the users at MSE parking forums disagree with you!

    So please either accept the appeal by cancelling, or supply a popla code so I can cost you £27+vat. And don't place this on hold for further information to be send you, there is nothing to add!

    Regards

  • Thanks Stroma :)

    Where can I upload the ParkingEye letter's content, so that it may help other MSE members?

    Scan and upload to Photobucket or similar if you wish, then link to it in this thread. I doubt it is anything new though.
