    But the arguments and the answer to them are going to run along similar lines, what can you say that is fundamentally different to get your point across for a ticket ? I mean saying this is an appeal on a parking ticket can't really be changed can it?

    Saying that genuine pre-estimate of loss cannot really be changed, because at the moment that is a winning argument, when it stops being one the advice will change to reflect that.

    The Assessors are not stupid, they probably read this forum and pepipoo so they can learn about the issue, they probably think its hysterical when their names are posted on here, I know I would lol

    What will happen if I just ignore the fine?
  • It's not a fine, only courts can issue fines. By their admission it is not a penalty either, it is just an invoice for what they claim was a breach of terms and conditions on the part of the registered keeper.

    Please don't ignore this when it's only going to take 2 emails to get it cancelled, you've even been given the wording on the first one, so it will take you maximum of 5 minutes to set the wheels in motion. And for gods sake don't tell them you are emigrating as you will have claim against you as they know they'll get a default judgement

  • Ok Stroma, I've copied and pasted your letter and edited what I need. I have just used the first point you raised. The rest I'm not sure as the signage to be fair is ok and I don't know how I can argue the third point? Or am I just raising arguments anyway?

    you are ensuring they prove their case, their signage , their contracts , everything

    many is the time they have failed to follow correct signage rules etc (BPA guidelines)

    many is the time they have no actual lawful contract to enforce these "rules"

    it is almost always the case that the "charge" is not enforceable as its not relevant to the losses incurred by the landowner for the "incident"

    I'm sure that you have got better things to do with your time with planning to emigrate - but you don't have a crystal ball and know what the future may bring!

    If you just ignore the "fine" (which is not a fine but a parking charge) then Excel potentially have 6 years to pursue the alleged debt and issue court papers. If you are not in the country then you run the risk of having a CCJ registered against your name, last known address etc in this country - which may have an adverse affect on obtaining credit in this country - should you return. Once registered the CCJ will last on file for 6 years.

    With banks also being internationally intertwined, there is also the slim possibility that banks may check your credit rating and previous banking records where-ever you emigrate too. Experian PLC for example operates in 70 countries world-wide.


    This parking charge can be cancelled very easily by following the advice already given. The POPLA appeal can be submitted on-line and you will receive the outcome by e-mail - which you can pick up anywhere.
