parking charge leeds crown point (excel parking)

right folks im new here and would be greatful for a little advice, i was parked at crown point leeds and i left the site for all of 15 mins excel parking services ticketed my car window and i have now received a letter through the post stating a different contravention to that of whats on the ticket, do i have grounds to appeal on ''procedural impropriety'' also the signage is s**t small writing sandwiched inbetween other writing and the car park is free to park in anyhow and i cannot see how they justify £100 or £60 if paid in 14 days as they havent lost anything in the space of 15 mins and the car park was virtually empty as it was early morning

contravention codes i got were

AO=walked off site on the slip
and on the letter ''reason for contravention'' parked in a restricted area of the car park, and it doesnt state i was parked in a restricted area on the slip, any advice would be appreciated kind regards paul

    to be blunt, it doesnt really matter what the ticket is saying, they are money grabber scammers for the most part and will use any excuse or silly rule to try to extract up to £100 from you for parking on private land and not obeying their "rules"

    bear in mind they do not care what you think, they just want your money, so you need to wise up, learn to play the game and beat them at it

    you also must do this within certain timescales , so its soft appeal then popla for you

    1) This charge is not a genuine pre-estimate of loss
    2) You do not have the authority or permission to give these invoices to motorists
    3) Your signage is inadequate, and does not comply with the BPA Code of Practice

    You are therefore invited to cancel this charge now, or supply a popla verification code to appeal to them on rejection, where you will be asked for a detailed breakdown of the above.
    As you know all appeals on the points above are upheld.

    Please confirm cancellation within 35 days of the above date

    However procedural impropriety does mean they can no longer claim in court against the RK, only the driver. POFA 2012 states that they must put the reason for transgression both on the NtD and the NtK so they have failed!

    Not that it matters overmuch. Appeal as previously advised then appeal to POPLA for the usual reasons. You can throw in the above reason as well to give the POPLA adjudicators some variety.

    (POFA requirement 8(c) has not been met
    "state that a notice to driver relating to the specified period of parking has been given and repeat the information in that notice as required by paragraph 7(2)(b), (c) and (f);"

    as the information given in the notice to keeper under 8(c) is not the same as that given in the notice to driver 7(b)

    Therefore keepr liability does not apply and only the driver is liable for the charge. The operator has neither named the driver nor provided any evidence who the driver is


    Once 56 days are up the operator cannot correct their mistake and send a new NtK. You could then point it out to them that they have not fulfilled the requirements of POFA 2012. If they send any communication after that which implies POFA 2012 or RK liability applies then they are in breach of DVLA requirements and you can complain to the DVLA and BPA

  • Hello people back again finally with a rejection of my appeal and was given a popla code to appeal with popla direct, can anybody show me a template i could use to appeal to them direct thanks in advance.
