    Dear UKPC

    I am the registered keeper of the above vehicle and deny any liabilty to pay the parking charge on the basis that the driver did not form a contract with UKPC on the day in question due no signage being present.

    I further contend that the parking charge does not represent a genuine pre-estimate of loss for any alleged breach you perceive the driver to have contravened to yourself or the landowner. In every case where a motorist has raised this issue, POPLA have accepted the appeal.

    You are therefore fully aware that there is no prospect of your charge being upheld and I invite you to cancel the charge now.

    If you decide to continue to pursue this matter and reject this challenge then please supply a POPLA code. However please be aware that further points including (but not limited to) no contract with landowner and/or driver or authority to pursue parking charges in own name, inadequate signage etc may be raised at POPLA.

    Please note that should my appeal be upheld at POPLA for any reason, I reserve the right to claim my expenses from you and my time in challenging this parking charge at the court rate of £18 per hour.

    The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail. ''

    If you have a photo of the broken sign, then I would amend the previous excellent appeal by saying that the driver could not have made any contract as the supposed contract was incomplete as per photo enclosed.

    So UKPC replied back to me. They have told me there was sufficient signage and that it is penalty charge and therefor a pre estimate of loss is not applicable. They have not followed on my request for a POPLA code.

    How should I respond to this?

    They told you in writing that it was a penalty charge? What does it say on the ticket?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Penalty charge? You must have quoted that wrong, surely?! Do you mean 'contractual charge'?

    Please show us a pic of the sign and confirm that there is no POPLA form attached to the letter nor any code/form printed on the back of it, small print, on the reverse.

    and yeah sorry I read it wrong the first time. Its not worded as a penalty charge. I cant see a POPLA code anywhere. I will call them tomorrow and ask.

    Nope, don't phone a PPC! This isn't a nice, fair company you know! Their agenda is money, you don't phone them up.

    Instead, look at all the other recent UKPC threads on the first few pages here as they do this all the time. We always tell people to complain to the BPA. You can also complain about the PPC trying to enforce a charge when the sign was unreadable, and now you've appealed they have not sent a POPLA code. Send the BPA pics attached to your email (the sign and the reply to your appeal).

    BPA email addy for Steve Clark is in the NEWBIES thread. The more complaints about this sharp practice, the better.

    Ok thanks, also I read through the sticky the best I could. I will contact BPA then!
  • That sign looks to be attached to a lamp post - may be worth contacting the council re their permission or if legal etc.

    UKPC seem to be habitally failing to supply POPLA codes at the moment. - though please check the bottom of the letter is it is sometimes printed there.

    So as well as complaining to the BPA as advised above:

    I am assuming the appeal was not made until the NtK arrived?
    If so also make a formal complaint to the DVLA as this breaches UKPC's KADOE contract for failing to adhere to the code of practice.
