3 PCNs by smart parking in a week. pls help.

Hiya,
I'm a newbie pls bear with me.
I currently have 3 PCNs sent by post to me by 'Smart Parking' where the alleged breach occured on 3 separate occassions/days.
I am the RK but not the driver.
The driver overstayed past the free 3 hours at the retail park. They work in the evening and have been parking there in that manner for some time now, with no tickets.
The vehicle entry times for the 3 tickets were around 4pm and exiting times around 8pm.
All this time, The driver just assumed that the restriction ends by 7pm when the shops are closed. (Although, there is still a burger king and subway open at that time).
Its so unfortunate as I am expecting maybe 1 more.
Any advice as to how to go about appealling this.
Thanks for your help

yep, plenty of advice on appealing it
specifically, as a newbie here , you should be reading the NEWBIES - READ THIS FIRST sticky thread at the top of this forum, about the 4th one down
everything you need to know is in there, links , templates , appeals , everything , if it isnt linked in there, it doesnt exist
ps:- it also matters which region of the uk you are in too, due to different laws, you never mentioned this0 -
I am in England. Just checkin, do i need to appeal each PCN separately0

I would have thought so, or you do one soft appeal listing all 3 or 4 pcn,s at the same time on the one docket , so one soft appeal against 4 identical pcn,s , that way it costs them 3 or 4 times as much at popla0 -

I am a bit scared of the fact that the driver was not actually shopping at the retail park. Thus no receipts available.0

irrelevant ( they may not even have a contract to issue tickets !! )
send them 3 or 4 soft appeals like this in post #17 https://forums.moneysavingexpert.com/discussion/4852905
preferably by email , as RK, do not name the driver or imply who the driver was0 -
Would you be so scared if the demands you had received originated from a fake bank in West Africa?funkyboyuk wrote: »I am a bit scared of the fact that the driver was not actually shopping at the retail park. Thus no receipts available.
No. Exactly.
It will be Smart Parking's (the well-known parking oxymoron) argument that the parking is limited so as to allow maximum access to customers. That hardly applies here. The driver is employed at the location and was contributing to the profitability of the retail outlets in an entirely different fashion. Their argument, like that of all private parking companies, is baloney - as we all know. Their interest is in maximising profits for them.
Smart Parking's parent company is based down under and in reports to shareholders their claim to be looking to increase profits in the UK by closely examining and matching the "market rate" for "Civil Penalty Tickets" (as they describe them) is not exactly in line with the requirement that any charge they seek to levy is actually a genuine pre-estimate of loss they will have made because someone parked over time. Its a nonsense and their Australian published notes lay bare the real thinking behind their tickets.
By the by, Smart Parking don't do court. They will stamp their feet a few times but you can head that off at the pass by using their appeal system and then defeating them at POPLA (with our guidance).
There is nothing to worry about here. Chill and go and pull another drink from the fridge/make a tea/coffee or pour a glass of wine.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
Appeal three times using the template linked too above, when they reject that they should give you a popla verification code for each one, you will need to appeal to popla three times also. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Oh give over, this is Smart Parking with a fake PCN, easily seen off! Appeal them like everyone else does and win it at POPLA like we do 100% of the time. The 'Newbies read this first!' sticky thread tells you how to appeal (a dozen links to adapt to suit) and then 'How to win at POPLA' is also linked there, with examples.
It's nothing to do with whether the driver shopped there or not.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
