Smart parking

I have received a letter from smart parking stating that I owe them £120 or I'll be passed to debt collectors?! judging by reading other threads I never received the first letter, how do I go about challenging this? Any advise would be appreciated.

Many Thanks

  • A few details would help here:

Is this in England or wales?
Date of alleged parking contravention and date your letter arrived - you will have to challenge that this was the first correspondence received - surprisingly many PPCs have missing mail!

Please also confirm that this was on private land as Smart parking do have contracts with councils for on-street parking (mainly London)

    Read also the Newbie thread:

  • It's for my local asda store based in Biggleswade, England for staying over free time on 26/9/13. This letter is dated 17/12/13 but I only received it this weekend and it gives me until 31/12/13 to pay!

Yep we know how they like to demand money! Please do read the sticky threads, the 'Newbies' one already linked by 4consumerrights includes a section about appealing anyway even though you might be too late. And the one about 'successful complaints about PPCs' has at least a dozen linked examples of complaints to Asda.

Always read the sticky threads on a forum first! The ones at the top with the word 'sticky' next to the title which tells you they are stuck to the top like on a noticeboard.

Is this the first letter ? Is this the notice to keeper? If it is they are well out of time and over the limit of £100 set by the bpa

  • This is the first letter I have received but I believe it's the letter that's sent after the notice to owner. I'll be sending a few appeal letters this evening if that's the case.

It will be rejected, so don't admit to being the driver, appeal as the registered keeper. Were you driving as the RK or someone else?

  • I'm the RK, bit stuck as to what to do as I know I wouldn't have been in the carpark longer than 20 mins, possible that I made 2 trips into the store but I work in a pub round the corner so if I needed to be in town longer than that I would have parked there.

The chances are that they will reject this, and won't give you a popla code either. Far better to use your energies on complaints to the landowner/retailers I think

Bit stuck what to do, when you already have 10 answers?

See this thread and use a version of the letter in post #30 if Smart reply that you are too late to appeal (when you appeal):

And you do realise that debt collector letters are nothing? A bit like Smart Parking = nothing?! Not sure why people panic so much about a speculative invoice with as much clout as a Burger King flyer. You should have appealed it in time but then you've been given links that tell you what to do now to appeal it late. This is no biggie.
