Please could you explain the nature of the fault. Even if it's minor, Section 18(3)(c) requires that the goods be free from minor defects.
Thanks for your comment. The faults with the phone are that I am unable to recieve MMS messages, the internet is erratic (not network problem), am unable to set the phone to download my emails or send emails. All these problems were tried to be resolved in store by the store technician but could not. He agreed their was a problem with the phone and adviced me to send it away for repairs. (This was at the start of the sending away)

What a ridiculous comment. Of course they do. Many iPhones last for considerably longer than this for example.

I think that's dependent on how you define "last". My iPhone is the 4S model, and I used to be able to work my 14hr shift, taking my phone with me without the charger, and use it on my breaks (totalling just under 2 hours of using 3G Internet, as well as checking my phone inbetween) and have a battery of 30-40% left by the time I got home, if I turned off searching for wifi and automatic email updates.

Yesterday my battery was 1% when I got home under the same usage and my minimum term ends in February, so I don't think its ridiculous. Certainly won't be getting an iPhone again anytime soon.

Switch off location services (Settings, privacy, location services) for apps where you don't want them constantly checking where you are and close down the apps that you aren't using. It's quite straightforward, but many people are running apps that are constantly polling for location or checking data (whether that is Facebook, runkeeper, weather, etc)
    1. Have you tried to Google the answer?
    2. If you were in the other person's shoes, how would you react?
    3. Do you want a quick answer or better understanding?
