Car hit from behind, other driver admitted fault but my car deemed to old for repair?

    What about actually helping people with plain and honest advice based on YOU actually having the appropriate experience that qualifys your posts.

    Seems to me that there's plenty of that, except it doesn't suit your tastes. Sorry 'bout that.

    I said "get the injury looked at". Not "go to the doctors having rehearsed at which points to shout 'ow' to when poked, in order to get a specific diagnosis.

    As someone who is still in daily pain from a rear end accident that happened in 2004, let me assure you that whiplash injuries are very real.

    I wouldn't say they're being screwed over by the third party Insurer, they appear to have contacted the OP at the early stages to offer settlement.

    The OP estimated the value of their car to be £750, if you ignore that most people over estimate the value of their car and take £750 as it's true value. The third party offered £500 cash settlement which when a third party insurer settles they do not include the value of the salvage. So the OP would keep the car and could hopefully get it repaired for £500. The salvage value would be circa £250 so their offer was fair and could probably have been haggled upto circa £600.

    The claims management company have done the OP no favours by telling her not to talk to the third party insurers as the claim would very likely be settled far quicker.

    Which is precisely why I said that if they have injuries, they should be doing that regardless of how happy they may or many not be with the settlement on the car.

    Op, have you looked to see what an identical car would cost you to buy in the localish area?

    If it's being written off, I would be on the net now looking for identical make, model, number of doors, mileage, service history etc and seeing how much this would set me back. Knock off a bit for negotiation in price and aim for that as settlement. If they won't match that get them to suggest a replacement and send them evidence of what you have found. Then ask about the ombudsman.
  • Belinea2010 don't listen to anyone telling you that you have no rights with regards to your accident. I was in a similar situation having been hit from behind and completely not at fault on the 15th November (approx 30mph whilst I was just pulling off at a roundabout), my car was written off several days later and I am currently still driving the hire car supplied by the insurance company 2 days after the write off statement was made. I have contacted my insurance company several times for an update on the whereabouts of my cheque which is a significant undervalued amount and it seems for some reason the third party has still not posted it (current bill for hire car is £1600!!).
    I am currently using a solicitor (no win no fee type- i had legal cover so will not pay any fees) to claim back uninsured losses and pain in my neck, back, knee and hip (my foot was on the clutch at the time and has caused agonizing pain in my left knee and hip, in addition I still have neck and back pain 2 months on when sitting for long periods, climbing stairs, reaching above my head and any number of other activities!), they have arranged for me to see a private physiotherapist after going to the 'after accident medical' (last week) which will replace the NHS physio I am currently attending which was referred by my GP several weeks after the accident.
    Make sure you keep receipts for everyhting that the accident has put you out of pocket for and ask a solicitor for advice on what you can and cant claim for. Mine is insuring that I am fully reimbursed for the actual value of my car and getting compensation for my injuries and treatment - putting me back in the position (or as close as) I was before the accident. It's been inconvenient to arrange all of the above so far as I work full time and I don't understand why my insurance premium does not ensure that any of this is sorted for me but hopefully it will be back to normal soon.
    I really feel for you and hope you get the help you need and with regards to your injuries - they may seem minor at present but after a minor accident 30 years ago a colleague is still suffering neck and back pain now so please consider medical attention! Yes there are those out there who claim fraudulently but don't let this put you off you are not committing a fraud by claiming for compensation if you have experienced pain or suffering following the accident - this is what the service is there for!
