Car hit from behind, other driver admitted fault but my car deemed to old for repair?

    A repair company, we once used, increased it's prices when it became 'approved' by insurance companies, so we went elsewhere and saved.

    Where I live and what the car is worth has NOTHING to do with it and this is a silly comment. This situation IS the other persons fault as she HIT me and admitted being at fault. Whether I drive a £200,000 super car or a £50.00 old banger the principle is the same, it's not my fault SHE hit me and I deserve the same service from both my insurer and hers regardless of the value of the car.     They provided a hire car while my car was being assessed by my insurers engineer but as soon as the engineer declared my car uneconomical to repair they cancelled the hire car.

    They then said that an agent of MY insurer would arrange to collect my car and they asked for my cars documents and asked me to sign the V5 document and transfer ownership to them.

    I have not done this yet as it was so close to Christmas and I am certainly not signing the ownership to anyone until I have been offered a settlement that I am happy with.

    Also, I do not see why MY insureer is doing this, I am not claiming on my own policy, I want the claim to be against the at fault party's insurance so the claim shows as them being at fault on thier future insurance.

    They hit me and I am the innocent party after all.

    What did you expect to happen when your car was written off?

    At most you get to keep the hire car for 7 days following this.

    Unfortunately, your own insurance will be seeking to minimise their losses, not looking after you. You would probably have been better off claiming directly off the other person's insurance.

    It's a painful and expensive lesson and I know exactly what you're going through as both me and my partner have been through it. Drivers of older cars always get screwed in insurance claims.

    The problem you have is that while your car may only be worth £500, it's currently a reliable little car that you wouldn't have been prepared to sell. Any other £500 car for sale is exactly that... for sale... i.e. somebody doesn't want it any more.

    This post isn't going to make me popular here, but honestly if you can't get them to let you keep your old car with its (hopefully) cosmetic damage, I'd be getting your injuries looked at, claiming for them and putting the money towards either a slightly more expensive car, or reserve cash for problems with any replacement you buy.

    Which - since the damage is in excess of the vehicle's value - they do by paying you what the car is worth on the open market.

    <shrug> You were the one who raised the issue of your location and transport issues. If you're now saying they're irrelevant, then I'll agree with you cheerfully, since that was precisely the point I was making. If you - as I do - live in the !!!! end of nowhere, with no alternative transport, you have to expect that sometimes you're not going to have your car available. And you, yourself, have to make allowances for that. The reason is irrelevant.

    The way it usually works is that your insurer deals with your side of it, then liases with the other insurer to repay the final bill.

    Who did you first ring when you were hit? Whose claim form did you fill in? Who's providing your hire car? Your insurer? Their insurer? A third party accident management company?

    If the OP genuinely has injuries, then they should be doing that anyway.

    If they don't, then what you're suggesting is fraud. Yes, it is that simple.

    I expected a hire car for the duration it took to settle my claim, from the moment my car was hit until a financial settlement is agreed.

    That's what I'm paying my insurance for...

    You seem to forget, it's not my fault my car was hit.
