    So this secret clause they claim does not exist is actually a lie! Quite obviously they are saying one thing to users of their Facebook page, but do not consider you to be a customer if you don't spend more money in their secret clause

    I suggest instead of calling you actually put it in writing, anything can be denied over the phone
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    The lady on phone was very stern and would not give in one bit. She said if I could provide more purchase info or proof I am a regular customer they may reconsider. I cannot do this so fear even by writing, I may also fail to convince. Should I just pay this charge and forget about it? Will PE definitely issue a county court claim if I don't?

    The lady of course being Rachel Organ of Aldi, who is very pro parking eye! I would write to them saying that you are a genuine shopper, here is a scan of a receipt showing that there can be no possible loss to them or parking eye. I would send the same to parking eye as well.

    The reason is that though it's highly unlikely that a claim will be issued, it will be putting them on the spot as there can be no loss, and you have provided proof of you being a customer, they would be insane to issue a claim after as with the right defence they will be defeated there.

    In your email to them, tell them you shop there because they are so reasonably priced for their goods. That is why you didn't spend over their get out clause amount, which I understand would be a breach of consumer law if they had one and never told you about up-front. Your actions could have been different had you known about a secret and unfair term or condition.

    All speculation on my part, not from any legal knowledge I should point out!

    The Directive's general provisions on misleading and aggressive practices (Articles 5, 6, 7, 8 and 9) cover unfair commercial practices which are capable of distorting the consumers' economic behaviour.

    According to Article 2 (e) of the Directive material distortion of the consumer's behaviour means:

    "...to appreciably impair the consumer's ability to make an informed decision, thereby causing the consumer to take a transactional decision that he would not have taken otherwise;"

    To materially distort the consumer's economic behaviour means that a commercial practice impairs the average consumer's ability to make an informed decision and, in addition, that such impairment is significant enough to change the decisions the average consumer makes.

    Oh give over, don't PAY them! No PE do not seek court in every case, but why are you so quick to give up? Do you not have any other Aldi receipts among your friends & family that you can submit, even from weeks ago, anytime, which would show your family as regular Aldi customers?

    Ok so I have sent an email with some more receipts scanned. We'll see how this helps me.

    Don't think I'll get any reply until second week of January though as indicated by an automated reply..

    Sounds good, any receipts will show you to be a regular customer and if you keep replying and moaning I expect they'll cancel it. I got one cancelled by the Aldi Head office women (Rachel & Laura) with no receipt at all, just by sending a rant of a complaint on behalf of a friend who had missed the PE appeal deadline.
