Parking Eye Ticket

Hello, I'm a new member on this forum but have read many threads in the past. I got a parking ticket from Parking Eye in October for overstaying in an Aldi car park. I made a purchase in the store but did not realise the max time was 60 mins. I stayed for 2.5 Hours. I appealed to PE but not to POPLA. It is now too late for POPLA. PE rejected my appeal. I had sent them photographic evidence of my receipt and explained that wording on signage was too small. I was driving a company vehicle at the time. The original ticket was sent to my company but when I appealed, gave my details and implicated myself as the driver, they redirected it to my address. I was going to happily ignore this as I was aware that private tickets were unenforceable. However I was worried to find that this advice has changed and parking eye are submitting many claims to the courts. Should I just pay and cut my losses? Or should I wait to see if court papers arrive? I don't think I have a strong defence.

    When - presumably - PE rejected your appeal did they provide you with a POPLA reference (10 digit)? If so how long ago?
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    you may have wasted your best chance of beating the parking invoice (the popla code) but that does not mean that you have a poor defence , not at all

    if you have receipts or bank starements showing purchases in aldi, then complain direct to aldi as mentioned in the NEWBIES sticky thread at the top of this forum, getting them to tell the PPC to cancel the charge

    overstaying is not a crime, and do not assume the PPC have the right to do what they did , or are doing, a judge could easily decide the parking ticket is not enforceable, or that the charge is punitive, or there may be no contract etc

    so stop assuming and be pro-active in getting it cancelled, dont burn your bridges as its clear to me you dont know what those bridges are

    why did you not use the popla code ? out of interest ?

    I was relying on old information that I had read advising to ignore all Private parking correspondence without realising that advice had changed

    I will go to the store to try the angle you have suggested.

    I don't know of this makes any difference, but they do not have my correct name. They have a different forename but my correct surname. They have my address. Does this mean they may wasting their time by pursuing a person that does not exist?

    I say this because you may have to get their head office involved, but you should certainly start with the store manager, you wont be the first, nor the last , as can be seen by the number of facebook complaints they get too

    in theory they pursue the driver , but due to POFA they can pursue the registered keeper, which the dvla have named , so although the details of the name may be slightly different, by implication YOU are that RK and I dont think a judge would throw it out purely on a name issue alone

    Thanks for your reply. Just to clarify, I am not the registered keeper. The RK is a company. I furnished my name and address to PE as the driver. The forename I gave, however, is not my correct one.

    Would it be a better idea to complain directly to aldi's customer service email at their head office?

    You gave an incorrect name deliberately? I'm sorry but that's bloody stupid! If this goes to a court this will be used and the district judge will probably find against you on that !

    Now go to Aldi and make complaints, email scans of your receipt to customer.service@aldi.co.uk and tell them you are a genuine customer and to cancel this invoice.

    Can I make a suggestion, never lie! Especially on paper or email because it can come back and bite you! There's no point doing that for a poxy invoice from a scamming parking company
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I did not deliberately lie. I am just known by another alias which is not my legal name. At work I use this name. I just thought it may help me as PE are not pursuing me by my legal name.

    I shall send photographic evidence of my receipt and ticket to Aldi.

    they pursue the driver, you were the driver, so you could use mickey m mouse if you like and you are still answerable for this parking charge as the driver

    you would not want this coming out in court so should do as advised and get it cancelled by aldi, otherwise you could come a cropper , especially when you could have so easily won at popla
