Problem with Samsung Tab 3 10.1 from Very Black Friday Glitch

Hi i purchased the tablet on 29/11/13 from very during the black Friday Glitch. The order was finally fulfilled and delivered on the 7/12/13.
The seal was broken when i received it,but i was not concerned as a lot of other customers had received theirs in the same way.See link

It was purchased as a xmas gift for my daughter.When she opened it today she discovered that the case was damaged and she was unable to set it up as it was not responsive.
What are my rights should Very exchange it at no extra charge,due to me having it less than 28 days.
i do not want a refund i would like to exchange it.
Could it have been a refurb?
Just need to know my rights before i ring them on Friday.

SoGA states that you can request a repair, replacement or refund but the retailer can refuse if your chosen remedy is impossible or disproportionately costly.
In other words, if it was a serious knock down price you'll likely find its disproportionately costly for them to replace (and possibly also to repair) so its not uncommon for retailers to insist on a refund in those circumstances.You keep using that word. As unholyangel stated, you can ask for an exchange but the retailer can refuse this request and give you a refund of the price you paid if an exchange works out too expensive for them.0

If you have no joy with Very in regards to a replacement/repair - You can go via Samsung for a repair as it comes with a 24 month warranty.

I have emailed Very about the situation and have been told to contact the supplier,surely thats their job not mine.Not sure where i stand now.Think a call to consumer direct is needed.0 -

Yes, your contract is with Very, and they can act as a middle man with Samsung if you wish, but it would be far more efficient to deal with them directly.0 -
If Very are sending you to Samsung this is actually a good thing if you want a replacement or repair. Samsung won't be giving a refund so its in your favour to be dealing with them direct.
If you start getting other parties involved its probably going to be easier for Very to refund and you will be no better off.0 -
I will contact the supplier and see what they offer me,i don't really want it repaired, but suppose as long as it comes back working i would be ok with that rather than having a refund.I will post what happens.0

Hi i contacted Samsung about the tablet,but they would not deal with me as my contract is with Very.On closer inspection of the box there is a dent on the side that is inline with the damage on the tablet itself.
I have since contacted Very,and been told to return it for inspection,but they are saying that because i have tried to set it up,it is not really returnable.I asked how was i supposed to know it does'nt work unless i was setting it up.
Going to be collected today,got to wait 7-10 days for refund to show on my account and then i can ring up and order a new one at the same price as Black Friday deal.Hopefully all will go well.0
