Scotland - UKPC not parked within lines - HELP!

Hi, I have read though many of the forum comments on parking fines, but some seem to say appeal, and others ignore.
Just came back after literally 5 minutes to a windshield ticket today on Christmas Eve. Happy bl**dy Christmas UKPC. Braehead Shopping Centre. Free parking. Parked in a plentiful space in my little ford ka, In an end space seeming same size as others, but with some strange lines on it but not all over it an not cross hashed. Ticket states 'not parked correctly within the markings of the bay or space'.
I am in Scotland (so think I can ignore as per Watchdog video?) but don't want to miss the appeal 14 days if this means my fine will double.
So can I SAFELY ignore? What will happen? Will they chase and chase and then give up? Have they no standing whatsoever and should I relpy to them at any point?
THANK YOU!!!

just read the NEWBIES-READ THIS FIRST sticky thread at the top of the forum (the one you missed)
tells you everything you need to know regarding scotland (and other regions too)0 -
Hi Redx, I did see that and it directed me to the Watchdog video, but I am very nervous about ignoring them, and will get more and more stressed if nasty letters come through.
I just need clarification that I should ignore from day one and have absolutely no contact with them ever?
Sorry to be a big baby!0 -
ff,
No need for nerves. In Scotland they can't go after the registered keeper if you don't identify the driver, so they're as stuffed as your turkey straightaway (if you're vegetarian you can find your own analogy!) So to answer your question, ignore them 100% of the time.
Their threats are on a par with a politician's promise - lots of words, some of them big, and all of them meaningless. It may feel intimidating, and that's how they want it to feel, but in the end you owe them nothing, nil, zilch. So sit back, laugh at the ever increasing threats and enjoy Christmas.

ps to save others, okay, Coupon Mad having to say it; IT'S NOT A FINE!!!!! You have not been fined, you have been invited to pay an unenforcable donation to their profits.0 -
well, obviously as you are in scotland you have different laws, that is why you see different advice on the forum, as its dependent on region
the options in england and wales are different, so the old advice was ignore for the whole country (when the watchdog video was in date) but you have different laws and so the PPC and DR can only pursue the driver I believe, possibly for up to 6 or so years - this has always been the case
so nobody can guarantee they wont track down the driver and prosecute them , that would be a silly statement to make so I wont be making it
I think its safe to assume that if you ignore this letter and every other DR letter you get, that if there has been no court case in 7 years from now then the statute of limitations will have run out !
you want a guarantee ? you wont get one unless you pay it, or unless you sweat it out for 6 or more years
if it did go to court, you may win, you may lose , again , no guarantees
here in england , we have ways of making these charges disappear under our laws, but before that it was a mess like in scotland (except we had clamping whereas you didnt)
but even here they can still pursue the driver, if they know who that is
ps:- its not a fine , never was and never will be, only a court can fine you
its a parking charge invoice for an alleged contravention0 -
I saw the undernoted quote from Coupon Mad so I hope it still stands...
UKPC DO NOT DO COURT. EVER. I WILL EAT MY HAT IF THEY START WITH A SINGLE LITTLE FAKE PCN IN SCOTLAND!0 -

In Scotland, your only other choice is to pay the scummers.
There is no legit appeal system up here and all sorts of other things that makes a PPC chancing it in court so highly unlikely that its not worth considering.
So just IGNORE them and stop bothering yourself! All the letters they are liable to send you are illustrated in the pre-POFA letter chain thread here already, so you will have a good idea of what to expect.0 -
Saying as it's Pantomine season....so nobody can guarantee they wont track down the driver and prosecute them , that would be a silly statement to make so I wont be making it
OH YES THEY CAN!!!
A PPC cannot prosecute anybody, the only thing they can do is make a civil claim, but UKPC have failed to do that in a single case, anywhere in the UK, and you can rest assured that they certainly aren't going to start in Scotland, where no PPC has ever raised a court claim.
I live in NI, similar to Scotland there is no independent appeals service. However, we do have the benefit of a legal system that prevents the spurious PPC claims that are being seen in England and Wales. I got a UKPC speculative invoice last January and I'm quite happily ignoring it.
There is no sweating to be done, you can rest easy, the chances of UKPC trying to take a claim against you are infintessimally small. You will receive the following computer generated template letters from UKPC.

Just tick them off the list as you get them, then sit back, relax, and ignore.
In Scotland and NI the recommended approach remains ignore, ignore and ignore some more.
The only thing not to ignore is court papers, and if you get them you will be the first in Scotland. All that is necessary for the triumph of evil is that good men do nothing. Edmund Burke Irish orator, philosopher, & politician (1729 - 1797).0 -
^^^ +1 ^^^Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You will just get extra junk mail in 2014 that's all, as shown here:

Come on, on this forum we have ignored these fake PCNs for YEARS, it's no biggie. I still carry around with me the letter chain I got 5 years ago, so I can show colleagues about this scam. The only reason we now appeal, in England & Wales is because we win at POPLA every single time and it costs the PPCs money. We would still be ignoring UKPC and other non-litigious PPCs otherwise.
I WILL STILL EAT MY HAT IF UKPC START THEIR FIRST EVER COURT CLAIMS WITH A SINGLE LITTLE FAKE PCN IN SCOTLAND!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
