Help, what are my rights.
Bought youngest a phone doe Xmas from O2 and then took it back next day because we could get a better deal on contract for exact same phone with carphone warehouse. Just took it out of box to charge only to find that a) no seal on box b) no protective seals on front and back of phone which leads me to believe it is one that has been returned to the shop. I have had many phones over the years and every single one of them has had a protective film on the front of them. I am real annoyed because I feel we have been palmed off with a used phone.
What are my rights, can I demand they give me a brand new one. I certainly didn't tick a box to say I would accept someone's rejected goods. :eek:

They will say that it's you who removed the seals and the film and you can't prove them wrong.

Didnt they open the box in front of you at the store?

Overlooking the fact you plan to give a youngster a contract phone (with the attendant risks to you and access to inappropriate content) - you have no rights to return unless faulty.
You are suffering from buyers remorse AND have a binding commitment for a service contract with (no doubt) a minimum term. They are not required to take it back - as it was your decision to take the initial unfavourable deal. Your rejection needs to be undertaken before you leave the shop.0
