As you discovered, being 'reasonable' is not reciprocated, and comes as a shock to many who feel they are bring unfairly penalised.

Regarding your no 'notice' of default - they are not required to provide any. Only agreements made under the CCA require this, and give a short period to rectify the issue. No such requirement for a mobile. If they do as you wish following your complaint, great - however history shows that there is little leeway, and as long as there is no accuracy dispute, it will stay - the justification being it is an accurate reflection of how the account was conducted.

  • Hi Lee

I've just come across this thread as I'm in a very similar situation. The start of my dispute actually dates back to July 2012 when a Vodafone employee at the Vodafone shop in Meadowhall advised me that he had cancelled the remainder of my contract as requested after I had previously received poor service.

A default has since been placed against myself by Vodafone for a balance I do not owe them. I argued the matter with Vodafone and at no point was told a default would be placed against me. It was never a matter of affordability, more a matter of not being willing to pay a bill I do not owe.

I have reported the case to the financial ombudsman service who at this moment have advised they cant take any action until I receive a deadlock letter from Vodafone. Despite me asking Vodafone for a letter stating their position several times - they have instead sent me brief emails asking me to call them in response! I've never received such unprofessional and poor customer service before.

I've just come across this post and saw your response to the previous poster - I thought I'd give this a try!!

Please can you try and help me. Account reference 68500560.

    Thanks in advance.

If you've waited 8 weeks from the original complaint to Vodafone, you should be able to get the FOS to accept the complaint on that basis alone.

    Hi jamietuck,

Thanks for making me aware of your case.

Unfortunately the account reference you've quoted is missing a digit. So you can provide me with your details securely, could you email me with them via the link in our profile here?

All you need to do is copy and paste the link into your web browser and it'll take you to the Contact us form on our website. To make sure it reaches me could you also quote the code WRT135 - MSE in the subject line?

Once sent you'll receive an automated reply with a reference number. So I can make sure I've got it could you update the thread with this and I'll get back to you as soon as possible?

    Kind regards,

    Lee

Having worked for Orange, I am sure it is part of the t&c's that they will pass on your details to credit reference agencies (I imagine it'll be the same for voda).

Also, mobile agreements are (currently) not regulated under the CCA, so I believe this means they are not obliged to send a default notice.

From what OP says, the information is correctly recorded therefore, you'll be very lucky to have it removed. It will be purely down to the goodwill of Vodafone.
  • Hi Lee

Thanks for your reply. Sorry - the account number is 685000560.

    I've emailed you as requested.

PMDUK - Since the start of the dispute dates back so long, the Financial Ombudsman wont accept the case without a deadlock letter from Vodafone.

Thanks for your reply. Sorry - the account number is 68xxxxxx.

If that's your actual Vodafone account number, you should delete it and replace it with the Reference number of the email which is what Lee wanted.
