hi, i have just part exchanged my car for a van, i have the registration doc of the van and the dealer has signed it over to me, HOWEVER! he has now rung me because my old car has developed a fault(leaky rad, water pump gone) and is now demanding i pay £300 towards repair of my old car, he says if i dont pay it he will drop my car back and take the van away! he says he can undo the deal? is this possible

Tell him to p*** off sold as seen, he had the opportunity to inspect your car at hand over. If he removes your van report him for theft.I have a cunning plan!

sold as seen tell him to f*** off. if he had sold you car/van in that state without a warrenty he would tell you the same sorry it was sold as seen and left the forecourt in perfect condition0

i reckon he has got the !!!! and is just trying it on, it seems obsurd that he could take the vehicle back, and dump my old car outside my house

It's your van now, if he takes your van away he'll be stealing it, if he tries he'll face arrest.
The car is now his, if it develops faults it's his problem. The money, Dave...0 -
The only other thing is,was the fault present when you did the deal?or has it just developed.Regardless of "bought as seen" no one is aloud to misrepresent a vehicle. In other words, did he say is the car o.k and you said yes.
If i sold a car to someone and they asked me if i thought the exhaust was in good condition,i told them it was and it fell off on the way home,i could not say the car was sold as seen.If i was not asked to comment it would be the buyers problem.Burden of proof is an issue of course but these things are often discussed at the small claims court.
Have you got a warranty on the van?if so you may have problems with him if you claim. There are two sides to every story.

I can't see how he can take the van away without the key? Maybe he keeps spares to carry out this scam?! But yes if the van goes report for theft - or if you are genuinely concerned you can take the battery out and it won't go anywhere without some hassle. I wonder if it's also worth contacting dvla to bring the fact a seller is threatening not sending in the V5 conditional on receiving money (extortion/blackmail).
As others have said, if only it worked this way for customers at all car dealerships. He's definitely taking the mick and IMO some action needs to be taken but no doubt the police and trading standards won't be interested - but not saying don't try.
Besides, a leaky radiator and faulty water pump should not cost anywhere near £300 to sort out.
But this seems like a good warning. It's probably better to sell a car yourself than to take the easy option of trading it in and risk this sort of problem.
Perhaps this is his way of making more money? Lead customer in with an unbeatable deal (did the price on the van or offer for trade in seem particularly good) and use illegal tactics like this later to recoup the money.0 -
poochunks take a short trip down to the local police station and report him. If he is threatening you then say so, otherwise it's state you feel like you are being blackmailed. It is unlikely to be the first time he's done it.I'm not cynical I'm realistic

Don't know about others but I would be interested in hearing the outcome if possible. Hopefully it's a good outcome.0
