vacant possession

Jusrt trying to understand somethings on the docs i have been sent. The vendor has ticked "no" on the vacant possession box in the property information form, does this mean that they can still live in the house after completion?

    It means someone will live there - usually tenants.

    You will become a landlord. So read:

    (or insist on vacant possession and check it is empty before you Exchange.)

    So the vendor will continue to live there after you've bought the house. If youwa nt tol ivethere, you have to get vacant possession

    It's either a mistake by the vendor (most likely answer at a vague guess), or they are trying to slip the fact the house has a tenant under the radar. You MUST sort this out clearly. Refer the form back to your solicitor, query it, and query why he didn't highlight it himself. It's the kind of ... minor detail that he should spot!

    Yes I think its a mistake from the vendor (maybe first time sellers) assuming the question means is the property vacant now.

    Just get your solicitor to query it with their solicitor and corrected as necessary

    Dont ask for clarification through the EA or direct with vendor, do it through your solicitor.

    I would agree essentially that
    • You need to have Vacant Possession confirmed
    • That confirmation must come via solicitors
    Having said that, probably the quickest and most effective way of getting a boot put up the vendors backside will be to go to the agent and point out that if the vendor really does mean 'No Vacant Possession' then the sale cannot proceed.

    But confirmation should be sought via solicitors and it is only an answer via solicitors which will resolve this.
    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

    Yeah, I should add that a quick call to the EA to confirm it is indeed a mistake will be the fastest way but make sure that it is formally corrected on the contract (their solicitors may have to send an amendment).
