    Easy peasy......

The amount was taken by direct debit yes? Call your bank and do a Direct Debit indemnity claim for this sum.

You bank has to refund you - they have no choice. You will have your money back almost immediately. This is part of the Direct Debit guarantee and is useful in situations such as this.

Although they are entitled to a full and immediate refund, if they receive a refund that they are not entitled to then they have to pay the money back when the company asks them too.

So if RAC are refusing to refund the money then I can imagine them requesting the money again.

Thanks folks. Another email today refusing to budge as they have done nothing wrong from their end so have no 'obligation' to help.
Bank will assist but as is rightly pointed out it is only a short term solution if rac ask for payment again.
I have accepted i should have cancelled, i have accepted The 2 companies called rac are in fact unrelated (despite breakdown rac quoting conversation i had with insurance rac), i have accepted it was my responsibility to do everything and I would have- If i remembered instead of relying on the renewal.
Cant believe they are being so inflexible about this when I am still a current customer of theirs. Think I would be too terrified to actually call them if i had a claim or breakdown as i probably have a black mark against my details. :(
I pay all my utilities etc by direct debit but this has proved to be a painful bite in the bum!

Is it DD or CPA? They're different. RAC usually operate by CPA. Did you sign a DD mandate giving them your bank account number and sort code or did you give them the 16 digit card number?

I am not sure !! they quoted this in their reply to me

    Auto renewal

    Continuous annual payment:

    Direct Debit

    – With Your verbal or written authority, Your bank details are held on Our Membership database and Your account is debited automatically each year with full payment until You advise Us and Your bank otherwise.

I cant be sure what i did back in 2007 off the top of me head but it is a lesson to be more vigilant in future! Bank have advised a refund is no problem but if rac ask for it back I would be put straight back into this nightmare hence my desire to reach resolution with them.
i have kept my request for a refund very factual and waffle free but i guess deep down i wanted to cry about this spilt milk and receive a little compassion and goodwill, neither of which have been forthcoming from rac.
