The ETC is liable for VAT as it remains a charge for a service supplied (agreeing to the termination) this is not zero rated and never has been.
Something doesn't become a fact if you just keep repeating it. In fact the service isn't provided after the contract is terminated and this 'charge' is essentially a penalty for breaking the contract.
I know, your are an expert in everything, including taxes, but people that seem to be more knowledgeable in one particular area - taxation - keep saying the opposite.
And these incompetent idiotsrolleyes.gif from Orange keep openly committing fraud by not charging VAT on ETC and explicitly saying this in their bills.
As for OFCOM, this circumstance long predates them and even OFTEL - on consumer contracts all prices are VAT inclusive, and any ETC will similarly be the same.
'Similarity' isn't an universal tool for making reliable conclusions. There and their sound very similar.

Are people missing the point that this was a business contract and as such the VAT side of things may well be slightly different

  • Just put £360 in the bank account you pay the mobile contract from, and let the contract run out of its own accord.
