Credit report showing 1 late payment

Hi Guys,

Just wanting a little advice really.

A month ago my direct debit bounced on my mortgage payment. This was due to an unexpected outgoing and a transfer from another account not happening in the time frame I expected.

However as soon as noticed I called Halifax and offered to pay, payment was due on 28th I first called on 31st however was told collections was closed and payment could not be taken until the 1st and was assured this would not go on my credit record.

I subsequently called in the 1st and made payment again assured this would have no adverse effect.

I have now applied for a new mortgage only to be denied due to a late payment on my credit record. I called Halifax who said because it rolled into the 1st it was a late payment and was nothing they could do.


Surely it wasn't my fault I couldn't pay as collections was closed. Is this my fault, what can I do I have an otherwise exemply credit record but this is stopping me getting a new mortgage and indeed a good deal.

    Can you prove what was said over the phone?

    I suspect not, although they may have recorded the call.

    If they haven't recorded it it's your word against theirs.

    If they have it's grounds for having the marker removed.

    You'll likely have to make an official complaint and possibly take it to the FOS though.

    You could do an SAR and they should provide transcripts of any conversations they have recorded (they won't be all though.)

    Contractually the payment was due on the 28th.

    Correct, although the advisors statement may form a new contract (in regard to paying it on a certain date, that date being impossible to fulfil etc.)

    They really need a transcript or recording of the call however (the account notes may also mention it) otherwise they're on a hiding to nothing.
  • Thanks for the reply guys I'm hoping the account notes clear this up as it is obviously causing me a lot of stress :( I'm going to write a letter of complaint tomorrow as I believe this easier than trying to explain on the phone do you think this is a good course of action?

    Could you elaborate on the details here, specifically the timings of the inbound payment and the unexpected outgoing transaction type? (there may be a PSR or DD guarantee angle to follow up on).

    Why not appeal the decline, citing the reasons and your previous good payment history?


    Who are the relevant providers for the:


    1. Current account, and
    2. New mortgage


    Edited to add: And get yourself an overdraft facility on the current account ASAP (if indeed you can, with the late payment marker on your CRA file almost certainly already reported to the current account provider via the monthly feed they take from the CRAs). Mine's 2 x net monthly salary on my main bills account for peace of mind.
  • Hi Guys,

    It was the royal mail mortgage and they said that there was nothing I can do..

    However an update... Was upsetting me so much I called Halifax again today.

    The chap on the phone was very helpful and has put a case forward to have the late payment removed. He checked the account and said he could not see any report of me calling them though ( I find this a bit poor, surely they should log every call??) How can I prove I called if I need too??

    The chap on the phone said it doesn't mean it will definitely happen but he has taken all the details and put a case to the department that do it.

    I will know on the 15th of January as that is when there credit reports go out..

    Does anyone know much about this process??
    Does this more or less mean they are going to remove it?

    A single late payment would not be a reason to decline, especially if it was just a week or two late. Whoever said it would not be recorded was having a laugh - it's an automated process with computers doing the work.

    A DD is not a safe method of paying if you are on the limit every month - with no safety net, if something can go wrong, it will - look towards a protected separate account that only has this DD active, and keep it funded at all times for at least the minimum payment.

    Advisers don't have the power to amend contract terms. Contracts cannot be amended verbally either.

    I was talking about a seperate contract in the strict terms, i.e you do this, we do do this.

    It's a contract in real terms, I never said they could amend any current agreement.

    So it is a concurrent contract, with its own benefits and limitation.

    Since it is an irrelevance to the original issue, how does this assist the OP, except confuse?
