Well its the retailers fault
a/ He should of checked its condition before opening it

Threats won't help but go back with that attitude and you could find yourself in a cell for christmas.
The truth is pushing things into the power socket may well have damaged the screen or circuit boards, neither you nor I know for sure. As you have said a replacement screen is only a couple of quid, why not just accept that it could have been caused by the child and bite the bullet.0 -
You said the DS battery was dead and the power socket was broken. Unless the screen was visibly damaged when you took it in how exactly could the repairer verify the condition until they had repaired the power socket so it could be turned on?0

Maybe this can be a lesson to the little girl that if she doesn't look after her toys everything will not be alright!

You have stated that your DD has been poking things in the charger bays and that is why the unit is in for repair. What is there to say that she hadn't been poking away at the screen too and this is the outcome.
With the attitude you have shown on here, I would most likely err on the side of the repairer.
You just seem to be the type, who will not take any responsibility for things that they, or their family have done.
The repairer has most likely got a sign up, saying they do not take any responsibility for any damage caused to items left with them for repair. He could have left you to go home after getting the charger fixed. You would then either not notice the bottom screen, or if you did, could not prove that it was the repairer anyway.
MAN up and take a bit of responsibility . You say it is only going to cost a few quid, just pay it and get on with your life, instead of threatening vandalism, for not getting your own way.
If I was in the repairers shoes, I would tell you to do one and see you in Court !0 -

While I agree that there is little evidence so far that the damage was caused by the repairer, I imagine a sign such as this might be considered unreasonable under the Unfair Contract Terms Act section 16 1b).0 -
