    Don't forget to speak to the council and try to persuade them to prosecute for running an unlicensed HMO. If council succeed, your friend can apply for full repayment of all rent paid, as can any other tenants ;)

    But, TBH, after deposit return, best course of action is to email all council HMO employees, and do the sad face in local paper. That will stop others being sucked in.
  • Do you know who the actual landlords are and if they have any agents?
    You could download the land registry deeds for the house (a few pounds I think) and see what clues that provides.
    You could write to the actual landlords and alert them to the situation although i'm not sure whether current tenants can take action against the landlords if they are renting through a third party, maybe others on here will know?
    You'd be best off speaking to Shelter and asking for their help and guidance to get this place shut down.

    Thanks for all your replies.

    I have already notified HMRC about tax evasion. I have also asked all current tenants to contact council ask for them to obtain an interim management order and to prosecute her.

    I will once council is involved contact all the owners/landlords (if council hasn't done it already by then), I am waiting for the council to be involved to avoid a knee jerk reaction from the owners with possible illegal evictions.

    But please note I am not after the owners/landlords/letting agents, the owners of the current flats are unaware of what this girl is doing. My problems are not with them. Yes the evictions in the past were illegal but I'm still not after them either as it only happened because of this one person renting them out illegally

    I have already read everything on Shelters page and the involved councils about HMO/FMO's. I have really done everything I can to stop her it is now up to the current tenants to push the council to act, I can not do this I don't live there and never have.

    All me and my friend can do know to stop her is by ensuring she gets a CCJ against her name. This we want to do for as little as possible as we suspect we will not get any money when we win as she will probably run off to her home country. Our aim has never been the money we want to stop her from tricking people in the future.

    So my question is; for a claim for £580 (with or without penalties added) going through small claims what is it likely to cost us to get a CCJ in her name?

    Also if I can put a penalties claim through the small claims can I write the claim amount as £580 + interest, fees and penalties to only pay the court fees for £580 or would I have to write out the interest and the penalties and pay the higher court fees that would involve?
    If it is the latter than we will only claim for the £580 provided we can take it all the way to a CCJ.

    As well as any civil action you may take you should also report this to the police.

    Yes I would like to get one of the affected to do this, but what would the crime fall under?
    Sadly I usually find that you have to tell the police what to do as quite a few are reluctant to take reports/cases (they refused to investigate when someone stole and used my driver licence as ID, a friend was threatened with violence in writing and they refused that, and my partner was harassed by distant sellers and they refused tha as well).
