TERMS & CONDITIONS: There will be 12 iPad Airs to be won. The competition starts at 09.00 on December 22, 2013 and closes at 20.59 on December 22, 2013. Entry open to residents of the UK only. You must be over 18 to be eligible for entry. One entry per person, per hour. The competition will run over a 12-hour period from 9am to 9pm today. Winners will be selected at random from all entries received for each hour. If there are no entries in an hour, the winner will be selected from all entries received in the previous hour. There will be 1 winner per hour and 12 winners for the competition. Each hour will run from XX.00 to XX.59 (for instance, the first hour is 09.00 to 09.59). Each winner will win an iPad Air 16gb wifi-enabled. The prize will be delivered within 28 days, best endeavours will be made to deliver by December 25, 2013 but this cannot be guaranteed. The prize is non-transferable, non-refundable and cannot be exchanged for cash or any alternative. The prize cannot be sold or auctioned. Employees of TNL or anyone connected with the promotion are not eligible to enter. Draw will take place on December 23, 2013 and winners will be notified within seven days. Promoter is Times Newspapers Limited.

    Really? I'd have thought that once it belongs to the winner they could do what they wish with it? I mean, I wouldn't sell it but some might - it's not really up to anyone except the actual owner of the thing is it?

    Wow, thanks for pointing that out. It's the only reason why I try to win these things - people will pay hundreds for them on ebay and I'd much rather have the money. Obviously no point in me entering this comp.

    But yes, it does seem odd that once it's yours, they're trying to claim that they have some power over what you do with it . . . can that be legal?

  • I don't think it can possibly be legal - otherwise one would have to assume that they retain some degree of ownership over the item once you have won it and that would be absurd. I think it's just a 'frightener' - in my opinion a bit naughty because it's essentially unenforceable.

    i think The Times are just copying & using the same T&C for all their comps.. because it makes much more sense when talking about prizes like the cinema pass they were giving away yesterday (the card would of been in your name & could of caused some problems when trying to sell it)

    i cant imagine they care if you sold any other prize. anyway rival newspapers would rip them to bits if The Times tried to claim back prizes or take winners to court. :rotfl:

    Enforcement is another matter but by entering you agree to the T&C's and if they include "The prize cannot be sold or auctioned" you have agreed to it, a recent ITV one had a prize that included a car owned by some known "person" and one of their T&C's did not allow you to mention the previous owner if you later sold the car.

    It's a bit like a restrictive covenant you sometimes see when buying a house, the house maybe yours but you cannot do certain things with/to it.
