Letting agent problems

    Hi,
    Just wanted to check that you received the letter from me on Monday regarding notice. I took the advice given to me by you and gave one months notice from the 25th June.
    Please could you let me know as asap regarding the amount of pro rata rent for July then i can get this to you before it is due.

    The letter was hand delivered so i know they got it.

    I would strongly recommend that you stop offering advice if you have no knowledge of the most basic of tenancy rights.

    While it's fun conversing with you, I shall decline your recommendation as I am right. Throwing words around like "Broken in" and "Illegal" sound good, but are not correct.

    Whilst the clauses may be 'un-enforceable' and 'unfair' I do agree with thesaint in that they aren't actually 'illegal' in that there are no laws to prevent them being there?

    However, the landlord may be acting illegally if he follows them through...

    The terms are contrary to the law of the land. It is no more legal than if the landlord wrote "The landlord may eat your babies if you damage his property" in the contract.

    Eviction other than according with the provisions of the Housing Act is illegal under the Provection From Eviction Act. The penalty for breach is up to two years in prison.

    It is normal use of the English language to describe a contractual provision that if enforced would constitue a criminal offence as illegal.
