ignore any DR letters or strongly rebut the charge with them , denying it and to refer back to creditor, plenty of info in the NEWBIES sticky thread about this
PE should send the new PCN to the driver , which is then soft appealed and you insist on a popla code if rejected
DR cannot take you to court, only the creditor/landowner or his legally appointed agent
bear in mind that at this time of year its bound to move slowly or not at all0 -
I have recieved a e.mail from debt recovery plus ltd . I stated that i wasn,t the driver and had only just recieved the letters but they are saying its to late to change anything and i have to pay £135 by 6th Jan. Is this right as i have written to Parking eye telling them i wasn,t the driver and that my wife was the driver. Do i just wait for there reply.
Thanks for any advise
An email from DRP? They usually write but I guess you emailed then (big mistake if that's your usual email address, never let a debt collector have that).
So reply by email and say they are addressing the wrong party because you have given the driver's details to ParkingEye and only that person can now be considered potentially 'liable'. As such it's unlawful to harass you as registered keeper and you will report Debt Recovery Plus to the Credit Services Association unless they confirm they have reverted to their client to check the driver details instead. In addition, if they use this email address for any purpose or contact you in any way you will also report them to the Information Commissioner as they cannot store data or contact details for a person who is not the alleged 'debtor' (not that a private PCN is a debt).
Please go for the Morrisons complaint, this is disability discrimination which is illegal. You could have just emailed the CEO by now (as per the examples given above). The CEO's email address is in post #3 of the 'Successful Complaints about PPCs' sticky thread where I got those example links from.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi
Just got a Private Eye letter.
I was in the car park of a pub belonging to a major chain. Called the pub manager (name on their website) explained I had reserved a table that day and spent quite a bit of money in her place and stayed over the time - my fault, plus I obtained a refund of the charge I did pay when I settle the bill.
She took a note of the claim reference number and is arranging for the notice to be withdrawn
My advice (in some situations) is not to tear up/ignore the charge letter, be pro-active sort it with the company employing Parking Eye in the first place - if you can. If you were there when you should have not been then you are still 'on your own'0 -
Have written to the CEO of Morrisons, they responded just after christmas saying did my Mother have any receipts. I explanded that she doesn,t keep receipts for a few groceries and that she only carries cash, shes never had a credit card i her life, sent this replie on the 31st.Should they of replied by now or is it good news no news and they might be trying to do something? Parking eye haven,t responded to the letter i sent them before christmas stateing that my wife was the driver, i know they got the letter as i sent it recorded delivery. Any advise please0

usually they wont sign for recorded delivery, so hope you got that proof of delivery by checking online ?
if neither have replied, given that they have say 35 days to reply, its pointless worrying about it yet, leave it all in their courts
seems premature expecting a reply when you must realise they would be closed for xmas and new year, just let them get on with it as long as you know they received your paperwork0 -
Can Parking eye still take me to court even though i have told them i am not the driver and disclosed who is? They recieved the recorded letter on the 23th Dec0
-
in theory , no they cannot as you discharged liability by naming the driver
once a PCN goes to the driver, you are absolved of liability from what I know (but dont quote me)0
