Parking eye parking ticket

My wife has just given me 2 letters from Private eye parking dating back to 08/10/13,she also says she had a earlier letter but it got ripped up and 1 letter from Dept recovery plus ltd demanding £135 as i have ignored the letters. She says that if she ignored the letters we wouldn,t have to pay and that she didn,t want to tell me and hope,d they would go away. The letters are in my name as the car is in my name but i almost never drive that car as i have my own car. She says she was taking my Mother who is very old to Morrisons and she didn.t now there was a time of 2 hours. She left the car park after 2 hours and 37 mins witch for my Mum is a quick shop . She has never been to this shop before. Is it to late to appeal. What should i do? Thanks

please read the newbies-read this sticky thread first (above this thread in the stickies)

then check the details on all the dates and if its E+W or not as advice differs

ideally start by trying to get the landowner to cancel the charges , but make sure that if you are still withing the time limits that you appeal asap

then come back for more help if required

ps, all this is was a simple overstay, nothing more

and ignoring the letters in E+W will never make them "go away"

It is PARKING Eye not PRIVATE Eye. ;) (But you're not the only one to make that mistake. Even a solicitor representing Parking Eye called them Private Eye in court! :D )

You are the registered keeper - why did your wife get the postal notices? Or did she see what they were and open them before you could see them?

ok, so do as I said in my earlier reply, then come back once you have a strategy in mind

Stating you've no idea who the driver was will change nothing - they will be pursuing the RK as per PoFA when it is not known (or is withheld) who the driver was.

If you name the driver you reset the clock and the PPC is forced to pursue them, with all the appeal opportunities and timescales reset in the process.

If your partner is up to it, then give PE their name and address. If you are also able to use an alternative address to your own (partner's relative, or place of work) it will help - but not essential.

There's no reason why you can't handle everything then for your partner, but everything must be sent in their name once PE pursues the driver.

This really is your best chance. Once you've done this, check it all out via the NEWBIES sticky, but also keep in touch with us here for ongoing advice and reassurance.

When your partner gets their POPLA code make sure you post up a draft of your POPLA appeal here before submitting it.

What happened when you complained to Morrisons CEO about this disability discrimination? Have you got a receipt or bank payment you can take a copy of, send one to PE and one copy to Morrisons with a robust complaint:

Successful complaints about private parking tickets - how to get them cancelled!

That sticky info thread about complaining was right there in front of you at the top of the forum before you ever posted (up there as a permanent info thread along with the 'Newbies read this first' thread). With 3 links to Morrisons complaints about PE. Missed the sticky info threads so far? If so have a read of the links there on the forum already.

Right but she was a genuine customer, is elderly (slower on her feet) and as such is covered by the Equality Act 2010 like these cases were:

(DISABILITY DISCRIMINATION AGAIN, 12MIN OVERSTAY) & PARKING EYE - http://forums.pepipoo.com/index.php?showtopic=85001

ALDI & PARKING EYE (DISABILITY DISCRIMINATION) - http://forums.moneysavingexpert.com/....php?t=4739136

MORRISONS CEO (MATERNITY/INDIRECT SEX DISCRIMINATION) & PARKING EYE - http://forums.moneysavingexpert.com/....php?t=4762460

That's just three cases picked out of the dozens and dozens of examples in the Successful Complaints about PPCs sticky thread. And if it's a faff to travel back to the store you can deal with Morrisons Head office by phone or email the CEO, as is shown in post #3 in that same sticky. Be assertive. Equality Act 2010 breach by Morrisons' agent, what are they going to do about it?
