Unfair dismmisal case??

When I read it, I saw that it happened 2 days BEFORE you went on holiday. So was the next day a working day & you took that off too without telling them?
Or was the next day a Saturday or Sunday & it was not open?
In all fairness you did have that day & the next day & the day you left to go on holiday to talk to them about this.
Did you go abroad or where you at home & off or in the UK?
You said you were alone & then you said you told "one of the girls" you would text his wife, so was someone else there or did you ring/text one of your work mates about it? If you found the time & remembered to text her, how come you couldn't ring/text your boss or his wife?
I don't know a thing about employment law, these are just questions that leapt out at me & a tribunal might ask you. It might be wise to have answers.0 -
With regards to the reference it unfortunate but an employer is not allowed to give a bad reference. However, theycan give a factual reference such as he did.
I wonder what you mean by a "bad reference". If you mean that an employer can never say anything which can be construed as negative about an employee, that is not true. If you mean that a bad reference is an untrue one, that is a different matter.0 -

My advice to you would be this; forget about it. Just get a job somewhere else and explain that if they leave you alone in the building with no contacts or cover, then you'll do exactly the same again. I'd hire you on that basis alone. Call it having principles and a sense of morality, something lacking in modern society.
Your ex-boss sounds like an obsessive.
Off topic I know but ts_aly2000, can you enlighten me on how you got Post Count: 433
Thanked 1,531 Times in 893 Posts0 -
I'm not ts-aly2000 but - the "Thanked" figure doesn't mean that the poster has been thanked by others that number of times. It seems to me that what it records is that they have thanked other people that number of times using the Thanks button. HTMS0

you can be thanked by multiple people for the same post0 -

That answers it then:D
It was, not as the other posters replied, but that you had been thanked in more posts (896) than actually showed in total (440).0 -
Hi, Martin’s asked me to post this in these circumstances: I’ve asked Board Guides to move threads if they’ll receive a better response elsewhere(please see this rule) so this post/thread has been moved to another board, where it should get more replies. I wouldn't drop this.
You have already lost the opportunity of another job because of the reference supplied by your old boss. If he hasn't followed correct procedure then thats is his problem. Don't let him get away with it. How long will you be unemployable for because of this?
Just make sure you have yourself covered - and it looks like time is not on your side to deal with this. Get advice quick and get it sorted so you can move on.After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

From what you have said here, leaving the premises and not notifying management that could be construed as gross misconduct, as it would affect the customers' perception of the business, and ultimately lose business. I don't know anything about the NHS licence but if that's true then that strengthens the case for gross misconduct.
However, it doesn't sound as if they followed correct procedure (which is where most people win tribunals) so you may have a case. You'll find ACAS to be very helpful.
As for the reference, you can't do anything about that. They can say whatever they like as long as it is true. Just don't give that company as a referee. If asked why you could say there was a personality clash and you don't think it would be positive. (as an employer I'd be suspicious of that, but I know a lot of companies don't take up references now)0
