I worked for a firm since 1985 was taken over but my employment carried on in 2004 I became ill with pnuemonia which has resulted in (amounst other illness ) me still off work .
I met a old workmate the other day and he told me the firm had been sold and all staff were made redundant and paid out their monies, around 2010 /2011,
I have never been told of this or received any letters or corrispondance in this .
Do you think they have pulled one over on me because I was out sick ?
Am I still entitled to my money ?
How do I go about it ?
I do suffer with deprssion now and have anxeity and panic attacks with face to face meeting .
any answers would be gratiful

Let me get this right.
You started work for a firm in 1985.
In 2004 (that's 9 years ago) you took time off sick and basically haven't been back since.
You have now found out that in 2010/11 that your old colleagues were made redundant and received payoffs, and you want to know if you're entitled to anything?
I'm sorry but :rotfl:0 -

I don't know where this stands in law, but I think you're being unreasonable too, as Smiler has said.

Your best answer would be to call or visit your local Citizens advice.
If you have been off sick since 2004, have you been in receipt of SSP? Have you kept in contact with your employers - either sending in sick notes, or calls, or letters? Have you moved since 2004 and do they know of your new address?
I would seriously doubt that you would be entitled to redundancy as you have not been in work since 2004 (9 years?) and as such I would strongly suspect that they would have terminated your employment on ill health a long time ago0 -
I am in receipt of incapacity benefit yes but I do not have to send in sick notes .
They did pay me ssp for 28 weeks at the beginning and no I have not moved or changed my phone number since being out sick .
My son-in -law worked at the same firm until he left in 2009 and the bosses were always asking after my health .
Surely if I my employment was terminated I would have had my p45 ,I still have 2 weeks holiday money and one weeks in hand money with the firm .
My tax office sends the company my tax codings every year admittedly the last one they sent was 2010/2011.0 -
It looks as though it could have gone into administration, of which the honest answer is that I dont know the answer to this, too.
We've bought a number of companies, which have been dissolved soon after, but this was due to a merger (of which staff were kept), rather than lack of funds.

You must be entitled to a heap of holiday pay now as well0

Whilst you would no longer have to submit sick notes to the DWP after your assessment period, did your employer say you no longer needed to submit proof of your sickness to them?0

I think its only backdated one holiday year?Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -
Hi yes the company agreed that their need for sick notes was passed to the dhss0

It does sound very odd. It would be normal to expect someone off sick for this length of time to be dismissed on capability grounds by now, but equally you should have been notified of this, received a P45, etc.
If the business has gone into administration then, while its poor practice, its not impossible that you might have been 'forgotten', depending on what exactly has happened and how exactly your status was recorded up to now.If you don't stand for something, you'll fall for anything0
