Council Housing list appeal

Hi all, I'll be brief.
Been through the mill recently & moved home (in private rented) changed our housing list application & didn't hear anything back from the council. We chased it up & were told we were taken off the list because we didn't respond to their letter within 21 days. It was sent to the old address.
We appealed & the council have still not responded but most importantly, not within the 10 days specified. Does this mean that our appeal is awarded as their time has expired?

Does the appeal process say that the person with the complaint automatically wins by default if it isn't processed in time? If not, just assume that the decision is late rather than in your favour.0

You should be able to re-apply, the 'appeal' will likely be to determine whether your 'new' application is backdated to the date of your original 'cancelled' application - or from a newer more more recent date.
This is important because most 'waiting lists' include an element of 'time on the list' - making the 'application' or 'registration' date really important.
Generally all schemes include an element of 'tell of significant changes' - the onus is on the applicant.
I would take a 'gentle gentle' approach and gently prod them tomorrow by e-mail/ phone, letting them know that you are keen to get back on the list and whether they can can exercise their discretion to back date your application - because it's Christmas!
