Three cancelation policy/false advertising.

Hello,

I recently became 3's customer and about 3 months ago I made a contract with them for my Nokia Lumia 1020 (black). I was happy and still am with that decision, the battery is the only thing that's really quite bad, but apart from that I am fine with everything else.

However, 5 days ago I made another contract with 3, it was nokia lumia 1020 (yellow) basically same phone, different color and slightly different contract for my sister. She's a heavy phone user (she watches a lot of videos, social networking, surfing, etc). If she uses the phone all the time the battery will go from 100% to 0% in less than 3 hours, which quite frankly is a joke.

I've called 3 today to talk to them about returning the phone, however after being transferred literally 5 times and 25minutes later I was told that I would not be able to return this phone because it was used already. By used they mean that the data/minutes have been used. Obviously they would be cool with someone opening the phone and watching whatever else and taking pictures, but they're not okay with someone using the data.

I told those imbeciles that I was more than willing to pay for that usage, the one that was used to surf the web for 2 hours and any phone calls/messages that were made. But these idiotic morons kept telling me that it's not possible to do that despite the fact that this phone was used for less than 2 hours and the contract was made 5 days ago.

Is there anything else I could possibly do?

Or is 3 company seriously that greedy?

EDIT: False advertising
On their website it states that the talk time is up to 798 minutes, which is probably not even half of that. I had this phone for 3 months and I know exactly how bad the battery is. Can these morons really do this kind of thing? Say that it's up to 798 minutes? There is no way that they could get those kind of results even if they randomly took 10000 phones to test. The battery simply wasn't designed for it.

  • You knew how bad the battery was but you ordered another and want to return it because the battery life is awful? Do you realise how daft that sounds?
  • I'm not a heavy phone user, I don't use my phone often at all. I knew that the battery was not great because I would need to charge the phone every day/2 days. I didn't know that viewing media for 2-3 hours would kill the battery that quickly.

    Thats bad but not unusually bad. Talk time is NOT the same as endlessly watching videos/streaming etc. 3 hours media would kill my old iphone 4 and i doubt my xperia arc s would even last 3 hours. .
  • This is probably offtopic, but I would really like to know if someone has iPhone 5S, if so, how long would the battery last if you were to watch videos constantly?

    Its not particularly off topic. Its your thread after all. I can t help with a figure but as i said i got about 3 to 4 hours off the 4 and the 5 has more going on but a slightly better battery.

    The specs on the 5 say about 10 hours video (but they also said that for the 4). Thing is its not just playing video. I think all manufacturers are a little bit dishonest about battery use (like car manufacturers and mpg). You cant take things in isolation. Chances are you will have wifi on for streaming, you will probably have left gps on, you might have the screen as bright as possible and the sound up etc. It all eats battery power.

    Oops, just noticed there is a thread on the iphone 5 on here. The thread is complaining about bettery use so i guess its no better than the old 4s after all and answers your question.

    I take it you haven't read their terms and conditions for the returns policy?
    It clearly says:

    "If you’re thinking about returning or exchanging your Device (as applicable), you must return your Device in "as new" and "unused" condition. This means that you must not use the Device to make or receive any calls (both voice and video), send or receive texts or use the internet."

    I'd say three hours for a smart phone sounds about right if you are surfing the web and watching videos.

    Half the problems/complaints on this forum are actually created by/the fault of the user.

    Next time read the returns and cancellations policy. If you think there is a fault with the phone battery then ask for a replacement or repair.
