Letter from Newlyn - Court Action Pending

Hi

I raised a post back in March April this year i think after receiving letters from excel parking at peel centre stockport. I took the advice and ignored all the letters including the 'solicitor' letters. In the past week i have received the 2nd Newlyn letter - this one dated 4th december 2013 says court action pending unless i pay the £166.00.

From what i have read - the old ignore is old advice now and also too late to go to POPLA so i am a little confused.

Should i just ignore these letters and they will stop eventually?

    - Search the forum for 'Peel' to read about all the other Peel Centre threads.

    - Search the parking forum for 'Newlyn', and read the other recent threads where these letters are discussed.

    - Don't do a general Google search for Newlyn as there are bailiffs of the same name and you'd be reading irrelevant alarmist stuff.

    - Read the sticky thread 'Newbies read this first' because I have written into it, what your options are at DC (debt collection letter) stage. It's not just a thread about how to appeal if you've just got a fake PCN.

    - Excel might try a small claim but the Peel Centre is a place where we know a few things and a defence would be strong. Excel would be beatable IMHO. Tell us if you get an actual Letter before Claim from Excel, or court papers, don't panic.

  • Thanks, yeah i read some stuff on here earlier but wanted to clarify what i read. I will ignore it until i get a letter before claim from excel or court papers...hopefully not though hey

    The board does advise a multi hooped time consuming POPLA appeal now, but as you have ignored past this , Ignoring is still a proven statistical tactic and anyone who can prove differently step forward figures in hand.

    I advocate POPLA where possible as it costs them money and I dont like parking scammers.

    Newlyns won't be doing anything, and considering they have never taken anyone to court in the past 12 months it will be a little difficult to force you to pay through the courts. However Excel do try their arm at court at times, their current stat is 100k tickets issued, and 66 claims. So do the maths.

    Ignore until or if you get a notice before claim
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Do Excel at Peel do windscreen PCNs? If not (and this was an ANPR "ticket"/Notice to Keeper) does the OP still have the option to disclose who was the "driver" and so discharge their keeper liability, and so reset the POPLA clock for the "driver"?

    Yes it will have been an ANPR ticket. As I said on another thread, Excel will say the driver should have seen the ticket the keeper got(!) even though that's drivel. Naming the driver is an option though and is spelt out in the newbies thread as I am sure the OP has seen; it would be a way of making himself not liable even if Excel try court.

    It can still be reset , are you the registered keeper? Were you the driver?
