Hi
I am in dispute with a solar PV company who have installed a system not agreed by me...I owe them a final £500 of a total £6500 payment, they previously refused the large payment of 6k on my cc as they said they needed a bank transfer. I wanted the s75 protection. They said they had insurances to protect me and there was no need. If I pay some of the remaining disputed money by cc, do I then qualify for s75 protection?

So you already have an issue with the Solar PV co, but want to pay a small sum by credit card, so they have to take the hit, when you try and get money back, or contract rescinded.
And we wonder why our Bank charges are so much!0 -
This could and I believe would be considered fraud.
To Pay a small amount on the CC only to try and claim £6,500 over an ongoing dispute before a CC payment would be seen as defrauding the CC company.0 -
No that's fine...I have asked as I was given advice to do this and I thought it was really not right..I was given links to mse to read about it so thought I would ask. Thanks for preventing a further problem

For the purchase to be covered under S75 of the Consumer credit act, provided that you make any payment (even as little as £1) then the credit provider becomes jointly liable for any breech of contract.
The £100 only refers to the minimum value of the goods that must be purchased.0 -

Depending on what problems you're having it may be reasonable for you to withhold payment until they complete their obligations under contract.
The courts would likely find that reasonable because once full payment is received, they know the company has little motivation for putting things right.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Hi unholyangel...I've been told that too. There are lots of problems and in my opinion, breach of contract and RECC/REALL consumer/installer code..I'm taking it to them as the guy changed the design which will affect the returns and gave me no opportunity to review the changes and approve/rescind. Other peeps told me to pay the outstanding money on my CC to get protection, it sounded concerning, hence the reason I posted on here for advice.
