    So my position is now that I have a Liability Notice dated 16/12/13. I was too late with my appeal letter !

    They now want £100.

    They have my name, but are sending the letters to my old address, which is why I have been getting all the letters late.


    Two choices I would suggest now, one or the other:

    1. If you have not got a POPLA code and yet your partner was driving then name the driver as your partner, at your new address, using this template:

    ...and then she should await her own Notice in the post which she can appeal. However Excel tend to wriggle about sending out a new NTK to a driver (but you have the advantage of being able to give a different address).

    2. The letter with the '3 choices', what was the date of it and did it give you a POPLA code? If so then use this (minus the first paragraph about the Equality Act):

    Even if it seems too late to use the POPLA code give it a try online right now.




    Or are those two not possible? i.e. if she wasn't the driver and you never got a POPLA code?

  • Just to add.... Our first appeal letter was sent to them 29th October and they sent a letter to say they had it on 12th Nov

    This is a violation of the BPA code of practice. A parking company must either uphold your appeal, or reject and provide a POPLA code.

    Dear BPA,
    One of your operators, Excel, has refused to provide me a POPLA code when I appealed. This is a breach of your code of practice. They have compounded this error by increasing the charge.

    I understand that this is a common and repeated practice by Excel.

    The POPLA lead adjudicator in his November newsletter stated:

    Verification code


    Operators must, on every occasion, include the verification code in their rejection of representations. The recipient of the rejection should not have to ask for it.
    Failure by an operator to provide a verification code in their rejection letter is a breach of the Code of Practice, sanctionable by the BPA.
    Rather than just a reference, the verification code should be clearly identifiable as such, for example:
    Your verification code, which you will need to appeal to POPLA, is XXXXXXXXXX.
    Even if the verification code is automatically printed on an enclosed appeal form, it must still be in the dated rejection notice/letter. If it is not, and if the issue arises, it may then be difficult for the operator to show exactly when the verification code was provided to an appellant.


    As this is a sanctionable offence, and as Excel are flagrantly and repeatedly breaking your code of practice I assume you will take the appropriate sanctions. As one of your larger member Excel should be providing the example, not trying to game the system.

    In view of their behaviour I assume you will be encouraging Excel to cancel the parking charge. If not, please ensure they provide my POPLA code immediately, which as I am sure you are aware, amounts to the same thing.

    If you continue to fail to police your members effectively I will have no hesitation in reporting you to the DVLA with the recommendation that they review your ATA status.

    I always park at big Tesco close by free of charge for up to 3 hours. I wouldnt pay Peel holdings for the dubious pleasure of shopping at the premises of their tenants.

    No there 100% wasn't. In fact excel have not mentioned it at all and haven't offered the code despite me asking for it in an email twice and on the phone too

Although we sympathise with your predicament we have no power to get an operator to cancel or refund any parking enforcement charges.[/FONT]

    [FONT=&quot]I have contacted the operator concerned to seek to determine whether they are non-compliant of our Code, as this operator is a member of the BPA. [/FONT]

    [FONT=&quot]If a member is found to be non-compliant of the Code, they would be subject to our Sanctions Scheme, where Operators who are non-compliant the Code can expect to receive a number of penalty points depending on the severity of the offence. As with driving offences, once an operator’s ‘licence’ has reached twelve points in any given 12-month period, then they are likely to be faced with suspension or expulsion. The Code of practice can be reviewed on our website; [/FONT]
    [FONT=&quot]However there is a process for you to follow if you feel that the ticket has been wrongly issued and is seeking to get it cancelled. This would see you initially appeal to the parking operator setting out your reasons for challenging the issue of the ticket. If the operator rejects this challenge then they are required to give you, the motorist details of POPLA – the independent appeals service for parking incidents on private land. This is a free service to the motorist and the decisions of the adjudicator are binding on the operator.[/FONT]

    That's a standard acknowledgement from the BPA and they will be investigating it now. They do always send the motorist the outcome as well (just be ready to maybe have to take issue with their findings if they reply with some old rubbish in favour of their Operator member).
