Car garage forged my signature?

Hi,

I need some advice please.

I put a deposit down on a car at a dealer garage, but could long story short they didn't fix the paintwork as instructed on deposit form so the sale was cancelled and got a full refund.
But ....the garage said after getting my deposit they sent of the log book to DVLA as I was wanting to buy it. They are now chasing me as DVLA will be sending me the log book in the post. The car garage obviously needs this to sell. But I didn't sign this when put deposit down and when I asked them how they got round me not signing they said they got the the Post Office to do this!

They are now hassling me via email for the log book. But I haven't received this yet. My question is: can the post Office sign log book on my behalf? If not is this fraud????

    When the log book arrives, drop it off at the dealership, case closed.

    dealership did OP no favours by fraudulently signing the v5c and sending it off without their knowledge at the same time not even doing a simple thing as to seal the deal in having things sorted on it as agree'd at time of "deposit given".


    TBH for the sheer nastiness i would simply send back to DVLA stating i had never even signed this document must have been fraudulently signed and have it null and void so it would cost the dealership money to apply for a new v5c.

    I agree, I do suspect the OP wants to be spiteful somewhere along the line, but the tickets thing is why I say return the V5.

    Agree, it must be sorted with DVLA only, the OP can get speeding / parking tickets and penalties for not taxing/ sorn and no insurance.

    It can only be put right VIA DVLA directly.

  • it would be fair of the OP to go to the dealership and hand the v5c and say sign this part i send this part and be done with it, but OP must bare in mind that any parking tickets, speeding fines etc from the date of issue of the v5c to them to the date of exchange of keeper details would be their liabilities.


    the right way would be to send the v5c back to DVLA with a cover note saying that the v5c was sent to them fraudulently as they had not signed the v5c.


    The PO would not have touched that V5C to sign it the dealership would have put it in envelope, and had the PO checked it to make sure it was in order if it wasn't in a envelope would gave it back to get signed, so with that in mind fraudulently signing a v5c and then lying how it came about to shift blame would reinforce my mind that i owe no favors to them, i cannot trust them, and simply send back to DVLA.


    in my original post i thought it be fair to go over the dealership and hand it to them to sign it and send it off, but rethinking it and thinking of the liabilities during that period and owing no favors to them, i would send it right back to the DVLA claiming its fraudulently sent to me using my details and that they should look into xyz dealership for fraudulently filling in and signing the document.


    i would simply block the email address of the dealership or mark it spam and write back stating that my intentions are to send it back to the DVLA do not contact me any further.

    Strange for any trader to complete the paperwork when they hadn't been paid in full. When it arrives, fill in the transfer to trade section in with the date you first handed over the deposit and give the trader a call and ask him if they want the rest of it (and you like chocolate/malt/flowers) or will you just post it all back to DVLA.

    maybe worth reading posts #3, #4, #5 & #6 for reasons why handing it to the garage is a very silly idea
  • When V5 arrives, call police, report the car as stolen. Wait for free car to be given to you by police.:D

  • More fool the garage for sending the V5 off..! I'd play them at their own games... when it arrives, fill out the change of ownership and add them as another owner, but don't tell them - just say its in the post.

    they will be really miffed off trying to sell a car with 2 extra owners on haha.

    anyone can sign the V5 - it wont be a forged signature, just any squiggle will do for DVLA.
