Appalling situation, proving there is no place for a PPC at a hospital.
Sickening story. Shame on the hospital, shame on PE. But most shame must be placed on the hospital, who, instead of telling PE to cancel, told the parents of Charlie to 'appeal'. If only they knew ..........Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I'm going to be writing to the CEO of Burton Hospital to tell her exactly what I think of their shambolic system! I shall be telling my relative to do the same too.
http://www.burtonhospitals.nhs.uk/departments-and-services/helen-ashley.htm
The previous system there was the ticket on the way in that you kept with you. Hospital could cancel it for specific patients that were entitled to free parking. Everyone else just paid on the way out. There was no way of over staying, over paying or being let out if you didn't pay. It was perfect but stupid Parking Eye decide to introduce an ANPR system which can't tell you how long you parked and how much you should pay. It's a ridiculous mess.
I think I mentioned the confidentiality thing in the Pepipoo thread I started about this event. If you had a lease car you wouldn't necessarily want your employer or lease company knowing about hospital visits. There's a whole issue of privacy that needs to be addressed.
Fortunately the relative that was got by PE is in fighting mood and they won't stand for the extortion PE are trying on.
Staffs county council are also in partnership with Capita now to deliver some services so they'll be getting an email about PE's behaviour and I will be asking whether in view of this apparent harassment of often disabled people or those protected by the equality act, Capita are fit and proper to be delivering services to exactly those kind of people.
I've just found the BPA charter for heathcare parking.
http://www.britishparking.co.uk/Charter-for-Healthcare-Parking
Includes such gems as:
Provide access-control and payment systems which are:
a) fit for purpose
b) properly maintained and in-service
c) easy to understand and use for all motorists including people with disabilities
Offer a high standard of management and customer service that:-
- a provides a safe, non-threatening environment for all carpark users
So I'd say PE were potentially in breach of both of those. Their ANPR system is a total shambles and sending nasty letters to car park users is threatening behaviour. Car park users also feel the need to over pay due to the awful nature of the systems and because so many visitors have had these demands for money with menaces from PE.
The above is more grist for the POPLA appeal anyway

its stories like these that really make my blood boil !!
its becoming clear that these hospitals and clinics that have employed a PPC are letting down their patients and visitors and there really needs to be some form of government dictat that ensures these things dont occur , same as with this whistleblower scandal
I sometimes feel that these trusts seem to feel they can do as they wish and not answer to anyone, my own trust (Tameside) was in a similar position and the CEO resigned before she was forced out and an emergency management team was drafted in , a few others of the previous regime also resigned, these same people thought everything was fine and no problems existed, yet the local coroner and the examining body both found glaring issues (not as bad as stafford but bad nevertheless)
they have also brought in charging BB holders simply because "the local council charges BB holders"
this "money see, monkey do" attitude seems to be a bad management idea and its also stupid when you think that councils are regulated by laws or statutes and different rules apply.
I dont see my grandkids being educated by my hospital, or my bins emptied by my hospital, so fail to see how what my council does or doesnt do has any relevance to my hospital, or vice versa
I sometimes wonder if these people live in the real world, I am also sure that they exempt themselves from parking charges and have their own defined spaces too, but its the devil take the hindmost for the great "unwashed"
clearly something should be done when even hospitals and clinics start employing bully boy highwaymen like in this case listed in this thread (and in other threads too)
so no, these PPC,s do not deserve to be on hospital grounds unless they have a valid fair system that doesnt penalise people in the manner they are doing now0 -
We all know that PE are bottom-feeding scum, who deserve no place on this earth. This story only amplifies that opinion. It is perfectly clear that they introduced a system which is deliberately set up to maximise user errors and thus their ability to scam motorists for money. There are 101 other ways of implementing a fair* system of charging, ticket on entry, pay on leaving being a well-established example. The Trust should also be held to account for failing to carry out due diligence on the system introduced. No doubt PE sugared the pill by offering a system whereby the Trust holds on to most, if not all the payments, PE making their money in their usual way, i.e. unlawful demands for money. But, no doubt, in the usual public sector way, the head of the Trust and those responsible for signing off such an awful system will be rewarded for their utter incompetence and go on to greater things.
*I won't get into what I think of charging for parking at hospitals in general, that's another debate.0 -
Hospitals should not be treating the halt and the lame thusly.
Here is a "humourous rant", (thanks Nigelbb,) which I wrote for another "event" which you are free to adapt.
T was surprised to see that you employ former clampers, xxxxxx to manage the car park at xxxxxx.
You may or may not be aware that this company is one of a number of similar private parking companies who use underhand, threatening, and often unlawful methods to bully, threaten and lie to extract extortionate sums of money from people, many of whom can ill afford it, for minor alleged breaches of non existent contracts..
For a few minutes overstay in a free car park, where there has been no loss to anyone, they will demand up to a hundred pounds in penalties, contrary to the Law of Contract. They use legalise, threats ,and scary letters from dodgy solicitors, debt collectors and fake bailiffs. They try to pass themselves off as police or councils, send out fake court summonses, produce false statements from witnesses, and take people, to the County Court.
Parking Eye have issued over 10,000 summonses in the last 12 months, although they rarely actually reach court as they know that they will probably lose nearly all of them .
To see the havoc and distress that these companies cause, (many are ex-clampers), visit the Parking on Private Land sections of fora as Consumer Action Group, Money Saving Expert, and pepipioo. They also feature from time to time on BBC Watchdog.
To sum up
These companies are vultures, preying on the ignorant and vulnerable . As a public body, owned by the taxpayer, you should not be an accomplice in their near criminal activities. Their so called Parking charges are merely speculative invoices
Having read this, I am sure that you will not wish to have your patients, many of whom do not have a great deal of money, and many of whom are not in good health, treated so shamefully and immediately take steps to disassociate yourself from this avaricious company. You never know how far you can go until you go too far.0
