    I argued the point but got nowhere I am afraid. And, of course, I needed a phone so I had to to buy a new phone as my old phone had been stolen when I had bags stolen on holiday. I didn't take it further as the phone shop said it was rare for Samsung to back down.

    Not sure what you think the scrutiny of a small claims is. Criminal courts are beyond all reasonable doubt. Small claims is only on the balance of probabilities ;)

    And perhaps this last paragraph is my fault for not explaining properly. The 6 month "rule" has no connection to your warranty. It is in relation to your statutory rights provided under Sale of Goods Act 1979.

    Under SoGA, if a fault occurs in the first 6 months, its for the retailer to prove its not inherent. After the first 6 months, the burden passes so that its up to the consumer to prove it was inherently faulty. Inherent just means that it was present at manufacture but not necessarily apparent (as an example....a component could fail prematurely if it was not soldered correctly - could work fine for years before failing though! but its still inherently faulty).

    If goods are inherently faulty and acceptance has occurred (it has most definitely occurred in your case), you can request a remedy (repair, replacement, refund - which can be partial) but they can refuse if it is impossible or disproportionately costly in relation to another remedy. However a repair/replacement should be done within a reasonable time and without causing significant inconvenience.

    I did have more typed but laptop lost connection, I lost my post and couldn't remember everything I said originally :D

    After requesting the other photo's I have today been informed that my device was escalated to a senior engineer who has now found that the phone should of been repaired under warranty.

    I am expected to get the device back fully working in the next couple of days.

    Good news and a happy man for Christmas.

    Im glad you have managed to get it sorted. It seems like you have to persist for Samsung to sort it out. Hope you get it back for Christmas :T
    Finally rebuilding my Credit Record :), HP loan to be paid off Feb 2014 and thats it :j
