Double Glazing Company 'gone bust'

I bought a whole house of windows and doors from John Williams in Mochdre N Wales in 2006 with a 10 year guarantee from the company. A crack appeared in the front door panel in the summer so I sent a clain form in (I have had a couple of bits done previously on this scheme and sorted fine) anyway after chasing it up for months I went to the head office today, spoke to the managing director and they have ceased trading because of the recession so the guarantee is now worthless. He tells me the credit card company and/or finance company are responsible for fulfilling the remainder of the guarantee (I paid £3000 on my M&S credit card and the rest on 12 months interest free finance) - is this true and if so what do I need to do to get things moving?

    You'll be claiming under section 75 of the consumer credit act.

    It makes the credit provider jointly and severally liable (basically you have the same rights with them as you do/did the retailer).

    Many thanks unholyangel I wasn't' sure because of the time scale and the fact it's a guarantee. Should I try the credit card company or Clydesdale Financial Services Ltd who did the loan (or both)?

    I'd try both. As above, you have the same rights with the credit provider as you do the company. It is part of the contract that you be provided with a 10 year guarantee.

    However, you should check the terms of this guarantee also. You may find you wont need to approach your credit provider if it has been underwritten. You also want to check what it says for accidental/physical damage (in case the crack has resulted from misuse) as usually they wont cover these types of fault and will reserve the right to invoice you if this is the case.

    Hi thumb remote yesi have seen that before but I bought a conservatory off them 8 years ago and my sister worked in their call centre at least 20 years ago so they have definitely been going for a while.

    So you took the advice of some scroat who failed in their own business?

    No the credit card company is not liable for the now worthless guarantee you purchased. (Yes you did purchase it, even if it was included in the original price of the goods sold)

    Next time ensure you get such a guarantee from an independent insurer.

    I would suggest you appoint a reputable company to come and repair or replace the door.

    Erm, both the credit card company and the finance provider are jointly and severally liable for the contract.

    I rang the CC company today. The lady I spoke to took all the details and I should hear back from them soon. She hasn't dealt with something like this before but thought it should be covered so fingers crossed.

    When I had a new back door and bay windows done in 2012 and 2013, the company offered me the option of paying a small fee for an additional protection in the event of the original company going bust before the guarantee had expired. Did you get anything similar?

    And I would suggest that you totally ignore the "advice" given by Atidi as it's obvious that they don't have any idea of how the consumer credit act covers situations such as yours.
