Can the landlord use the same address than me for a possession claim?

Hi all,

I just received a Claim for possession from my landlord but this last put the following address on the form (is using the same address then me while does not leave at my address) :
Claimant :

Landlord_Name,
102 Famous Street,
XR15 9OP

Defendant :
PeterHook,
First Floor Back Right Room,
102 Famous Street,
XR15 9OP
However, on my tenancy agreement, my address is just :
PeterHook,
102 Famous Street,
XR15 9OP

Thanks in advance for your help,

PeterHook.

No, he does not leave at this address and in our previous correspondence I was sending my letter to his solicitor.

The section 21 notice I received was sent by his solicitor who had wrongly my address as

    PeterHook,
    First Floor Back Right Room,
    102 Famous Street,
    XR15 9OP
    ,

    instead of just

    PeterHook,
    102 Famous Street,
    XR15 9OP
    .

I will write to his solicitor in order to inform them that it is wrong to add "First Floor Back Right Room" to my addressand that their client (the landlord) does not leave at this address.

There is another issue : in their claim for possession, they said that they delivered the section 21 notice under my door on 05 November 2013 while in reality they only sent it by special delivery that I received today.

Something else I find strange is that the section 21 I received today is dated 31 October 2013 but sent in an envelope at end September 2013. When I track it, it says :

our item with reference XXXXX45554XGB was delivered back to sender from our TOWN Delivery Office before 10:25 on 11 December 2013.

RoyalMail is making a confusion since the landlord has certainly put the same as his address, my address.

I may have made a mistake since I have hatched the "First Floor Back Right Room" on the my address on the possession form (since I was going to inform the landlord solicitor of the right address).

Signed for and on behalf of the landlord

    Solicitor own office address,
    GH9 0RT".

Is the section 21 notice valid since the landlord used exactly the same address than me as his address (without the "First Floor Back Right Room" for my address)?
  • let him have the first floor back left room, he didn't ask for the flat, let it run out, you don't have to leave unless you get a court order, wait till it gets to court and tell judge, he can have the room,

There is a misunderstanding : I live in a shared house and my tenancy agreement is just for a room (not the whole property).
  • then yes it might be valid, does he class him self as living there but really lives some where else, as if he does am sure you are classed as a lodger

I don't know how I can check how he class itself but in fact it is other tenants that live in the property with me and the landlord himself live somewhere else.

What about the date of reception of the section 21 notice (I received it today while I received the claim for possession the same day)?

PS : I could easily prove that the landlord does not leave at the address.
