Advice! Someone crashed into my parked car

    Well unfortunately this is when you find out how good your insurance company really are... when you need em most!!!

    You still have the option of taking the matter through the small claims court. The threat of that my change things dramatically.

    Yep.
    Fully comp insurance

    Which means they will pay for damage to your own car.

    Who you've already consulted, and they've said that you have no leg to stand on.

    Because if you claim, then your insurer are paying out. You will have made a claim on your policy.

    Because the legal proceedings stand no chance of success.

    If you are interested in the outcome I'll post an update when Diamond get an "updated" witness statement from the taxi driver.

    But the OP has a witness to say that the TP was there... that's providing the witness will either do an affidavit or even better, attend court himself.

    Not quite.

    The OP has a witness to say _somebody_ hit his car then drove off.
    He also has a piece of paper with a phone number and a registration.

    BUT

    He has nothing but supposition to say those details relate to the person who hit the car. The witness certainly can't testify that they do.
  • The witness saw the offender because he..."got out to check the damage to his own car, then drove off". Or words to that effect.

    The witness confirmed the reg of the car and provided the description of the driver.

    I parked infront of the taxi, so he would have only been a Corsa away.

    Ah, yes - you slipped it in to post 7. Sorry, I missed that first time round.

    OK, that's definitely stronger, but it's still not watertight - they could easily be cloned plates. The second note may have been left by another witness, with their own phone number. Why aren't they answering it? <shrug>

    Fill us in on how it goes. I've really had enough of people driving off after an accident. I see it regularly. I've seen someone physically dent a door to the point that it couldn't be opened yet drive off. Luckily, I was there to provide a witness statement for the victim.

    All Diamond are interested in is me paying my excess and losing my no claims rather than getting the 3rd party insurance to pay. So far I've refused to pay it.

    They (the other insurance co) always deny liability in these cases, I had the exact same happen to me, paid my excess, then got paid back after it was all settled.
