Flight delay compensation upheld by AESA

To Martin and Team Flight ZB7449 Malaga to East Mids 30.11.2012 delayed by 6 hrs. Monarch airlines claim 'extraordinary circumstances' and could not agree to our claim. As the flight was from Malaga I complained to AESA who inform me after receiving a report from the airline this case was NOT 'extraordinary circumstances' and considers that the airline should pay compensation. Monarch still refuse to accept their judgement. After all the form filling and agro do I really have to go through the small claim courts to register my claim. I would be grateful if any others in the same situation could advise also.
